AN ORDINANCE REPEALING ORDINANCE NO. 8727
AND PROVIDING FOR THE GRANTING OF "N' E. SET:'IENT
TO SE"lER IMPROVEMENT DISTRICT NO. 59 ACROSS
CERTAIN PROPERTY OF T`- CITY OF LITTLE; ROCK,
ARKANSAS, FOR TH_, PURPOSE OF LAYING AN OUTFALL
SEINER LINE TO THE ARKANS,i,.S RIVER, DECLARING
AN EMERGENCY AND OTHEI- PURPOSES.
WHEREAS, Sewer Improvement District No. 59 of Pulaski
Odunty, Arkansas ,is a duly organized and existing suburban sewer
district, organized for the purpose of providing sewage disposal
to a number of residents of Pulaski County and the City of Little
Rock, Arkansas, and is in the process of laying an outfall sewer
line across various tracts of lane. to the Arkansas River, and
THEREAS, the City of Little Rock, Arkansas, is the owner
of certain land South of the Arkansa; River in the Southwest quarter
of the Southeast quart =r (S!%4 SE') of Section 19, Township 2 North,
Ran -e 12 'i'dest; and in the Northwest quarter of the Northeast quarter
(NWT' NE-Z-) of Section 30, Township 2 North, Range 12 ''lest, all in
Pulaski County, Arkansas.
WHEREAS, Ordinance No. 8727 passed August. 27 , 1951
only granted authorization to cross a portion of said land and
it is necessary to have a right -of -way across all of said land
for the completion of the outfall sewer line to the Arkansas River.
, ERE.'3, the completion of this sel,;er line will benefit the
health and property of a number of residents of Pulaski County and
the City of Little Rock, Arkansas.
BE IT ORDAI1,ED by the City Council of Little Rock, irkansas :
Section 1. The Council hereby finds and declares that there
Is nn immediate need for the improvement and that a n�imber of residents
of Pulaski County and the City of Little Rock, arkansaslwill be benefitea
by s,--.id improvement and that the granting of an easement across the
property of the City of Little Rock, Arkansas will materially save in
the cost of this improve rent and facilitate its construction.
Section 2. The Miayor and CitST Clerk be an(_ the same are hereby
authorized to execute an easement deed to Sewer Improvement District
No. 59 of Pulaski County, Arkansas, granting a ten foot easement across
the 5;74 Sall, Section 19, Township 2 North, Range 12 I "lest and the NiN4 NE4
Section 30, Township 2 North, Range 12 ''est, in Pulaski County, wrkansas,
more particularly desc f-ibed as follows:
Beginning at t?.e north line of the C. R. I. & P. Railroad
right-of-way in the NT, 4 NE!, Section 30; thence northwesterly
to the north line of the N`1-4 TTE4 Section 30; thonce continuing
northwesterly trough the SIN-1 SE4, Section 19, to the South
bank of the Arkansas River.
Section 3. All ordinances or parts of ordinances i_n. conflict
herewith are hereby repealed.
Section 4. It is hereb7T ascertained and declared that there is
immediate neef7_, in order to protect the health and property of many
inhabitants of the City and County, for the improvement; therefore, an
emergency exists and this ordinance is necessary for the preservation of
the, public peace, healtt, and safety and shall take effect and be in force
without delay from and after its passage.
