AN ORDINANCE RELEASING, VACATING AND ABANDONING THAT
PORTION OF GAINES STREET BETWEEN 34th STREET AND THE
RIGHT -OF -WAY OF THE CHICAGO, ROCK ISLAND AND PACIFIC
RAILWAY COMPANY AND BETWEEN BLOCKS SIX AND SEVEN,
CALLOWAY ADDITION TO THE CITY OF LITTLE ROCK; ALSO
THE ALLEY THROUGH SAID BLOCK SIX BETWEEN 34th STREET
AND SAID RIGHT-OF-WAY.
WHEREAS, a petition was filed with the City Council of the
City of Little Rock, on January 14, 1952, asking the City Council to
vacate that portion of Gaines Street between 34th Street and the Right -
of -gray of the Chicago, Rock Island Railway Company, abutting Blocks
Six and Seven, Calloway Addition to the City of Little Rock, and
A twenty foot alley running North and South running through
said Block Six, Calloway Addition between 34th Street and said Right-
of-way, now appearing of record in Plat Book 1 at Page 95 in the
Office of the Recorder of Pulaski County, Arkansas, and
WHEREAS, after due notices as required by law, the Council
has, at the time and place mentioned in the notices, heard all persons
desiring to be heard on the question and has ascertained that the
street and alley hereinbefore described, have heretofore been dedica-
ted to the public use as a street and alley, and have not been actually
used by the public generally for a period of more than five rears
subsequent to the filing of the Plat; that all the owners of property
abutting upon that portion of the street and the alley to be vacated
have filed with the Council, their written consent to such abandon-
ment,, and that public interest and welfare will not be adversely
affected by the abandonment of such street and alley,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. That the City of Little Rock, Arkansas, hereby
releases, vacates and abandons all its rights, together with the rights
of the public generally, in and to the street and alley designated as
follows:
(1) That portion of Gaines Street between 3kth Street and
the Right -of -way of Chicago, Rock Island and Pacific Rail-
way, and between Blocks Six and Seven, Calloway Addition
to the City-of Little Rock, Arkansas.

(2) A twenty foot alley running North and South through Block
Six, Calloway Addition to the City of Little Rock, Arkansas,
from 34th Street to the Right -of -wag of Chicago, Rock Island
and Pacific Railway Company,
now appearing of record in Plat Book No. 1 at Page 95 in the Office of
the Recorder of Pulaski County, Arkansas.
SECTION 2. A copy of this ordinance duly certified by the
City Clerk of Little Rock, Arkansas, shall be filed in the Office of
the Recorder of Pulaski County, Arkansas, and recorded in the Deed
Records of said County.
SECTION 3. This ordinance shall take effect and be in force
from and after its passage.
