9117011-1, 1-1014 ORDINANCE N0. 9117 ,-AN ORDINANCE AMENDING SECTIONS 1 AND 9 OF ORDINANCE N0. 5745 AS AMENDED BY ORDINANCE NO. 5959 AND REPEALING ORDINANCE NO. 9016; ESTABLISHING FEE PAYMENTS FOR THE COLLECTION; PROVIDING A PENALTY FOR FAILURE TO PAY SAID FEES, AND FOR OTHER PURPOSES. BE IT ORDLINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCS, ARKANSAS: "SECTION 1. That Section 1 of Ordinance No, 5745 as amended by Ordinance No. 5959 ishereby amended to read as follows; "Section 1. That from and after the passage and approval of this ordinance, all garbage, waste, trash and refuse in the City of Little Rock shall be col]scted regularly by employees of the City of Little Rock and for said services the Sanitation Department of the City of Little Rock or its duly authorized representatives shall eolleat fees as set out in the following schedule: "1. A fee of six dollars annually shall be paid for each single. family dwelling house occupied as a residence and for each unit of a maltiwfamily dwelling house occupied as a residence, For the purpose of collection of the aforesaid fees, the Mayors, with the approval of the City Council, shall set forth by resolution the manner of payment of the aforesaid feese. "3. The date of May 1, 19539 is hereby established as the first day on which the new rates as herein provided shall become effective." That all the rest of Section 1 of Ordinance Noe 5745 as amended by Ordinance No. 5959 shall continue in full force and effect as presently set forth. SECTION 2, That Section 9 of Ordinance Noe 5745 as amended by Ordinance No. 5959 is hereby deleted in its entirety and is amended to read as follows: "Section 9. The six dollars annual fee may be payable at the rate of fifty cents (509) per month upon approval of the City Council and Mayor, or in any other manner, or at any other time, place , or in any ether amount designated by the City Council and Mayor. -2- "In the event the fees herein established are not paid promptly when due and there is a delinquency of sixty (60) days, there shall be a penalty of Two Dollars (2.00) levied on each delinquent fee in addition to the amount of the fee, and said penalty shall become a r part of and be collected with the regular fees heretofore levied, but in no event shall this penalty be levied more than one time in any calendar year. "Should the penalty and fees herein provided for be unpaid for a period of six (6) months from the time the first fee became due, the City of Little Rock is hereby authorized and directed to institute civil suit for the recovery of said fee with all penalties attached thereto, plus the court costs incidental to their collection." SECTION 3. Ordinance Ito. 9016 and all other ordinances or parts of ordinances in conflict herewith are hereby repealed, and since it is necessary to make proper precaution and regulations for the collection of garbage and since the proper collection of said garbage is endangered by reason of the fact that there is Rot adequate money on hand to collect same in a proper manner, an emergency is hereby declared to exist and this ordinance is found to be necessary for the immediate preservation of the public peace$, health and safety of the citizens of Little Rocks Arkansas, and the same shall be in full force and effect from and after its passage and approval.
