136041 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 K�17 31 32 33 RESOLUTION NO. 13,604 A RESOLUTION TO AUTHORIZE THE CITY MANAGER, MAYOR AND CITY CLERK TO EXECUTE ANY DOCUMENTS NECESSARY AND TAKE OTHER ACTIONS NEEDED TO PURCHASE A RESIDENTAL LOT LOCATED AT 1015 VAN BUREN STREET TO BE USED AS PARK PROPERTY FOR FUTURE WAR MEMORIAL PARK DEVELOPMENT FOR THE PURCHASE PRICE OF SIXTY THOUSAND DOLLARS ($60,000.00); AND FOR OTHER PURPOSES. WHEREAS, the Little Rock Board of Directors negotiated the sale of 3.82 acres of the City's interest in Ray Winder Field to UAMS and committed to reinvesting the sale proceeds to the purchase of land in order to offset the loss of City park acreage; and, WHEREAS, the residential lot at 1015 Van Buren Street is located south of Interstate 630 and west of Jonesboro Drive, and its purchase by the City and demolition of the residential structure will help to accommodate future War Memorial Park development that will complement the Central Arkansas Children's Library; and, WHEREAS, the Little Rock Board of Directors recognizes the importance of preventing a net loss of War Memorial Park acreage and feels that the purchase of this property would be beneficial to the recreational interests and the general welfare of the citizens of the City of Little Rock.; NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The Board of Directors hereby authorizes the purchase of property identified as 1015 Van Buren Street, and more particularly described in Attachment "A" to this resolution, for Sixty Thousand Dollars ($60,000.00), and hereby authorizes the expenditure of an amount not to exceed Three Thousand Dollars ($3,000.00) for a Phase I Environmental Assessment, recording fees and closing costs. Section 2. Contingent upon successful negotiation of the terms of the purchase agreement, a satisfactory title commitment, and a satisfactory Phase I Environmental Assessment, the Board of Directors hereby authorizes the City Manager, Mayor and City Clerk to execute any documents necessary and take other actions needed to purchase the property at 1015 Van Buren Street for use as a public park for the future expansion of War Memorial Park. Section 3. Funds for this purchase are available from the proceeds from the sale of the City's interest in 3.82 acres at Ray Winder Field to UAMS. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this resolution is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the resolution which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the resolution. Section 5. Repealer. All laws, ordinances, resolutions, or parts of the same, that are inconsistent with the provisions of this resolution, are hereby repealed to the extent of such inconsistency.
