20660t E / C 2 �v ORDINANCE NO. 20,660 2012076594 Received: 11(2112012 9:44:30 AM Recorded: 1112112012 09:50:33 AM Filed & Recorded in Official Records of Larry Crane, PULASKI COUNTY CIRCUITICOUNTY CLERK Fees $25.00 3 .�� I FIANCE TO CONDEMN CERTAIN STRUCTURES IN THE 4 �,,« ,pF LITTLE ROCK AS STRUCTURAL, FIRE AND HEALTH 5 HAZARDS; TO PROVIDE FOR SUMMARY ABATEMENT 6 PROCEDURES; TO DIRECT THE CITY MANAGER TO TAKE SUCH 7 ACTION AS IS NECESSARY TO RAZE AND REMOVE SAID 8 STRUCTURES; TO DECLARE AN EMERGENCY; AND FOR OTHER 9 PURPOSES. 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 WHEREAS, certain structures in the City of Little Rock, Arkansas, have become rundown, dilapidated, unsightly, dangerous and detrimental to the public welfare of the citizens of Little Rock; and, WHEREAS, the condition of these structures constitutes a serious structural, fire and health hazard; and, WHEREAS, such structures are a public nuisance and are dangerous to the health and safety of the occupants or other persons and, further, are in such condition as to be dangerous to the lives, limbs and property of people in its vicinity or those lawfully passing thereby; and, WHEREAS, such structures are declared a nuisance and immediate action is necessary to remedy these situations and said buildings should be rehabilitated by the owners or razed either by the owners or the City of Little Rock; NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The Board of Directors hereby declares that the following structures constitute public nuisances. The owners of the following described property are hereby ordered to immediately contact the Planning and Development Department, Building Codes Division and entering into an agreement providing for the immediate razing and removal of said structure within twenty-four (24) hours and to complete such removal within seventy-two (72) hours of the effective date of this ordinance. While not required by law to do so, the Planning and Development Department, Building Codes Division will immediately attempt to notify the owners of the property listed below of the passage of this ordinance by certified mail or personal service. The property on which the condemned structures are located by street address and legal description is hereafter set forth with the name of the owners of record, as follows: [Page 1 of 31 I 1. 1011 W. 15'h Street: Owner is Lendel - Aikens 2 2619 Commerce Street, Little Rock, Arkansas, 72206 3 Lot 10 -12, Block 271, City of Little Rock 4 Parcel ID # 34L- 399 -00- 001 -00 5 Zoning Classification: C -3 General Commercial 6 Ward # 1 7 Status: Closed former grocery store 8 9 2. 8301 Colonel Glenn Road: Owner is Asher Carwash, LLC 10 # 28 Club Manor, Maumelle, Arkansas, 72113 11 Lot 1, Block 5, Pike Addition 12 Parcel ID # 44L- 150 -00- 043 -01 13 Zoning Classification: C -3 General Commercial 14 Ward # 7 15 Status: Closed former car wash 16 17 Section 2. The conditions of the structures on the above - described property have been found to 18 present structural, fire and health hazards and are dangerous to the health and safety of the occupants or 19 other persons, and further, the structures are in such conditions as to be dangerous to the lives, limbs and 20 property of people in its vicinity or those lawfully passing thereby. 21 Section 3. The City Attorney is hereby authorized to institute such proceedings against such persons as 22 may be necessary in order to enforce the provisions of this ordinance so as to remedy the unsightly and 23 dangerous conditions brought about as a result of the failure of the owners thereof to maintain this property. 24 Section 4. The Planning and Development Department, Building Codes Division of the City of Little 25 Rock, Arkansas, is also authorized to raze and remove said buildings and file and enforce a lien against 26 said property for the cost of razing and removing said structures pursuant to Section 20 -32 of the Little 27 Rock Code of Ordinances. 28 Section 5. Severability. In the event any section, subsection, subdivision, paragraph, subparagraph, 29 item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or 30 unconstitutional, such declaration or adjudication shall not affect the remaining provisions of this 31 ordinance, as if such invalid or unconstitutional provision were not originally a part of this ordinance. 32 Section 6. Repealer. All ordinances, resolutions, bylaws, and other matters inconsistent with this 33 ordinance are hereby repealed to the extent of such inconsistency. 34 Section 7.
