RIGGS TRACTOR 6 COMPANY, FOR TRANSMISSION REPAIRS TO A CATERPILLAR 826 7 COMPACTOR FOR THE PUBLIC WORKS SOLID WASTE DIVISION 8 LANDFILL, IN THE TOTAL AMOUNT OF FIFTY -FIVE THOUSAND, 9 TWO HUNDRED NINETY -NINE AND 17/100 DOLLARS; TO DECLARE 10 AN EMERGENCY; AND FOR OTHER PURPOSES. 11 12 WHEREAS, the Caterpillar 826 Compactor for the Public Works Solid Waste Division Landfill is 13 currently at the J.A. Riggs Tractor Company shop for transmission repairs; and, 14 WHEREAS, upon teardown of the compactor, the Riggs technicians discovered additional and 15 unexpected internal damage; and, 16 WHEREAS, Fleet Services Department Staff has inspected the machine and agree that the additional 17 repairs are necessary; and, 18 WHEREAS, the additional repairs will cost Twenty -Four Thousand, Nine Hundred Eighty -Three and 19 18/100 Dollars ($25,983.18), in addition to the original repair quote of Thirty Thousand, Three Hundred 20 Fifteen and 99/100 Dollars ($30,315.99), for a total repair cost of Fifty -Five Thousand, Two Hundred 21 Ninety -Nine and 17/100 Dollars ($55,299.17); and, 22 WHEREAS, this Caterpillar 826 Compactor is required by the Landfill operation in order to comply 23 with ADEQ requirements; 24 NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY 25 OF LITTLE ROCK, ARKANSAS: 26 Section 1. The Board of Directors finds that, for the reasons expressed above, competitive bidding 27 should be dispensed with for the total repair of the Fleet Services Department's Caterpillar 826 28 Compactor, on which repairs have been commenced, and the Fleet Services Department is granted 29 approval to authorize J. A. Riggs Tractor Company to perform all necessary transmission repairs, for a 30 total repair cost of Fifty -Five Thousand, Two Hundred Ninety -nine and 17/100 Dollars ($55,299.17). 31 Section 2. The Board formally ratifies any contractual work done prior to the effective date of this 32 ordinance because of the special circumstances presented and the need to have this vehicle back in 33 operation at the earliest possible moment. Funding for this repair will be remitted from the Public Works Landfill, Fleet Variables account. Section 4. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance. Section 5. Repealer. All ordinances and resolutions, and parts thereof, which are in conflict with any provision of this ordinance are hereby repealed to the extent of such conflict. Section 6. Emergency. The ability to fulfill the mission of the Public Works Department at the Little Rock landfill, and to have all equipment working in a proper fashion, is essential to public health, safety and welfare; and emergency is, therefore, declared to exist and this ordinance, with its ratification of prior work, shall be in full force and effect from and after the date of its passage.
