ORDINANCE NO. 9328 .
AN ORDINANCE DECLARING THE OPERATION OF A CONVALESCENT
HOME OR NURSING HOME TO BE A PRIVILEGE; DEFINING A CON-
VALESCENT HOME OR NURSING HOME; FIXING A PRIVILEGE TAX
FOR THE OPERATION OF A CONVALESCENT HOME OR NURSING
ROME; PROVIDING FOR THE ISSUANCE OF A LICENSE TO
OPERATE A CONVALESCENT HOME OR NURSING HOME; DECLARING
AN EMERGENCY; AND OTHER PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE
ROCK, ARKANSAS:
SECTION 1. It is hereby declared to be a privilege
for any person, firm or corporation to operate a Nursing
Home or Convalescent Home within the City of Little Rock,
Arkansas.
SECTION 2. A Nursing Home or Convalescent Home is
defined to be the furnishing or providing, other than in
a hospital or sanatorium, of care for pay for five or
more persons who are invalids, semi - invalids, aged or
infirm, other than members of the immediate family.
SECTION 3. No person, firm or corporation shall
operate in the city of Little Rock, Arkansas, a Nursing
Home or Convalescent Home without first securing from the
City Collector a license. Application for such license
shall be made on a form to be provided by the City Col-
lector. The City Collector shall issue such license
Aldermen of the Ward, where said Nursing Home is located, the
after the said City Collector has notified the/Fire De-
partment, Health Department and City Engineer of the
City of Little Rock, Arkansas, and after he has received
from each of the Departments so notified a statement
that the premises to be occupied by such Nursing Home

or Convalescent Home comply with the applicable laws,
ordinances and regulations of the City of Little Rock.
SECTION 4. Each person, firm or corporation de-
siring to obtain the license hereinabove provided for
shall pay to the City Collector before such license is
issued to such person, firm or corporation, annual fees
at the rate of 75¢ per patient bed contained in said
Nursing Home or Convalescent Home,
SECTION 5. Any person, firm or corporation who
shall operate, have or conduct any Convalescent Home or
Nursing Home without having first secured a permit or
license as hereinabove provided or who shall violate
any other provisions of this ordinance shall be declared
guilty of a misdemeanor and upon conviction shall be fined
any sum not less than $25.00 and not more than $250.00,
or imprisonment for not less than two days or more than
30 days, or both fine and imprisonment in the discretion
of the Court, and each day's operation without a license
or in violation of any other provision of this ordinance
shall constitute a separate offense.
SECTION 6. Whereas Nursing Homes and Convalescent
Homes are establishments where aged, helpless and infirm
people are concentrated, and
Whereas the possibility of loss of life
through fire or through disease is greater among the
aged, sick and infirm than among other people, and

Whereas the City of Little Rock has
heretofore had inadequate control over Nursing Homes
and Convalescent Homes, and
Whereas all this creates a grave
danger to the public peace, health and safety, an
emergency is hereby declared to exist and this ordinance
shall be in full force and effect from and after its
passage.
