AN ORDINANCE PR7VIDING FOR THE BOARD OF BUILDING CODE
APPEALS PASSING ON MAATERIAL USED OUTSIDE OF CONGESTED
ARF,A.S OF CITY, AMENDING PARAGRAPH 5 OF SECTION 304,
CHAPTER 3, OF ORDINVTCE NO. 78882 AND FOR OTHER PUR-
POSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK,
ARKANSAS:
SECTION 1. That Paragraph 5 of Section 304, Chapter 3 of
Ordinance No. 7888 shall be amended to read as follows:
"The Board of Building Code Appeals shall have the power
to pass upon the true intent and meaning of the several provisions
of this Code and also upon questions wherein it is claimed that an
equally good or desirable form of construction or material can be
used in any specific case, and questions where it is claimed that
the specific case in ouestion because of location outside of the
congested areas of the City and /or the low hazard of the type
occupancy justify an increase in the area limitation, and to permit
the same if concurred in by the majority of said Board, but it is
expressly limited to those matters. The Board of Building Code
Appeals shall have no power to otherwise limit, modify or change the
Building Code as it now exists. It shall be incumbent upon the Board
of Building Code Appeals to hear and determine any due return thereon
as provided for herein. All rulings and decisions of the Board of
Building Code Appeals shall be final and binding upon all parties and
upon the filing of said decision with the City Secretary and the Build-
ing Inspector. It shall be the duty of the Building Inspector to enforce
the decision of the Board."
SECTION 2. That all ordinances and parts of ordinances in conflict
herewith are hereby repealed, and this ordinance shall be in full force
and effect immediately upon its passage and approval.
