9518f n ORDINANCE NO. 9518 AN ORDINANCE DEFINING FOOD STORE, MARKET, E eWYEE, UTENSILS, HEALTH OFFICER, ETC. FROH32MMG THE SALE OF ADULTERATED, UNWHOLESOME FOOD AND MEAT, REGULATING THE INSPECTION;.SE7T7NG FORTH THE RZ- QUMOCHTS OF SUCH ISTABLISHMTS; THE ENFORCffiMENT OF THIS ORDINANCE AND THE FIXING OF PENALTIES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. DEFINITIONS: The following definitions shall apply in the interpretation and the enforoement of this ordinance: Item 1. (a) Food Store: Any place or building and structure in connection therewith used, maintained or advertised to the public where food or food products are stored, sold or offered for sale to the public. (b) et: Any retail store in which meat is processed, sliced, or prepared to be sold. The term market shall include wholesale and retail fish markets. (c) "New" Grocers Store and Market: A food store or market opening for business for the first time, and provided that no food store or market has been operating at this location for twelve (12) months. Item 2. Emolovee: Any person employed who does or may in any manner come in contact with the food or food products for sale to public. Item 3. Utensils: Utensils shall include knives, cleavers, save, grinders, slicers, utensils or other equipment used in slicing or preparing moat or other food products for sale. Item 4. Health Officer: The term health officer shall mean the health officer of the City of Little Rock or his authorized representative. Item 5. Persons The word "person" shall mean person, firm, corporation or association. SECTION 2. Inspection of Food Stores and Markets: At least once every six (b) months the health officer shall inspect every food store and market located within the City of Little Rock. One copy of the inspection report shall be left by the health officer with the Operator of the establishment; another copy of the, inspection report sisal], be filed with the records of the Health Department. The Inspector shall write a detailed explanation of each violation upon the back of the inspection report. The person operating the establishment shall upon request of the health officer permit access to all parts of the establishment and shall permit copying any or all records of food purchase. SECTION 3. Examination and Condemnation of Unwholesome or Adulterated Food or Mgt: Item 1. Meat: Samples of food, meat and other substances may be taken and examined n by the health officer as often as may be necessary for the detection of unwholesomeness or adulteration. The health officer may condemn and forbid the sale of, or cause to be re- moved or destroyed, any food or meat which is unwholesome or adulterated. Item 2. Unwholesome Foods Not To Be Offered For Sale: No spoiled foods or spoiled canned goods, or any food that has been adulterated, shall be exposed or offered for sale; nor, shall any food product showing evidence of having been infested by weevils, roaches, flies, nice, rats or other vermin be offered for sale. Such material shall be destroyed or treated in such a manner as to render it obviously unfit for hump consumption. Spoiled or infested foods must be immediately removed from the stock of salable goods and segregated pending disposal. Disposal of quarantined or condemned foods shall be done under the direction of the health officer. Nothing in the above paragraph shall be so construed so as to prevent grocery stores from returning to wholesale company any condemned or quarantined food where credit can be obtained; provided a receipt for returned food is obtained and presented to the health officer. Item 3. No cleaning fluids, powders, or substances such as sodium trisulphite or derivatives thereof, or other chemicals that could be used for preserving, coloring or de- odorizing meat or meat food products shall be used or stored in any establishment or place selling or offering for sale any meat or meat products. SECTION /+. General Requirements: Item 1. Dog food or other animal food or feed, (unless canned) mast be entirely segregated from materials intended for human consumption. Item 2. Hamburger: Hamburger shall be composed of only comminuted fresh beef with or without the addition of beef fat or seasoning. The total fat content shall not exceed 30%. Item 3. All milk, fluid milk products, frozen desserts, pies, baking products, Mat., meat products and poultry shall be from approved sources. SECTION 5. Item 1. Floors: The floors of all rooms shall be of such construction as to be easily cleaned, shall be smooth and shall be kept clean and in good repair. Item 2. Walls and Geilings: Walls and ceilings shall be well painted or finished in an approved manner, maintained in good repair and kept clean. Item 3. Doors and Windows: When flies are prevalent, all openings into the outer air shall be self - closing, unless other effective means are provided to prevent the entrance of flies. Item. /+. Lighting: All rooms shall be well lighted. -2- Item 5. Ventilation: All rooms shall be properly ventilated. Item 6. Toilet Facilities: Every food store or market shall be provided with adequate and conveniently located toilet facilities for its employees. Such toilets shall be connected to the Little Rock Sanitary Sewer System, if available, otherwise, to an approved septic tank and absorption field. Toilet room shall be kept clean, in-good repair and well lighted. The doors shall be self - closing and handwashing signs shall be posied in each toilet. In "New" stores and markets, toilet rooms shall be well ventilated and not open directly into any market. Item 7. Water Suz) Hot and cold running water under pressure shall be easily accessible to all markets and those food stores handling any bulk or unpackaged goods which ordinarily are considered ready to eat with no further preparation. The supply shall be from the Little Rock Municipal Water Works, if available, otherwise, the water shall be obtained from a supply meeting the requirements set forth under the rules and regulations of the Arkansas State Board of Health pertaining to Semi - public Water Supplies. Item 8. Lavatory Facilities: Adequate and convenient bandwashing facilities on the premises shall be provided, including hot and cold running water, soap, and approved sanitary towels. The use of the common towel is prohibited. No employee shall resume work after using the.toilet room without first washing his hands. New markets and/or new stores handling bulk or unpaekaged goods which ordinarily are considered ready to eat with no further preparation shall install lavatory in the store or market. Item 9. Fjouirment. utensils and Fixtures: (a) All containers and other utensils which come in direct contact with food or meat shall be constructed so as to be easily cleanable and clean. The use of containers and other utensils which are badly worn, rusted, corroded or broken is prohibited. (b) Meat block shall be smooth, free from cracks and kept clean. (c) Knife Racks: Knife racks when attached to meat blocks or other fixtures, shall be completely detachable, made of material which is easily cleanable and clean. (d) Knives. Saws. Steak Hammers. etc.: Must be free from cracks, open seams and crevices. Shall be clean and free from accumulation of food and meat debris. (e) Mechanical Meat Grinders & Choppers and Any Other Difficult to Clean Device (including steak tenderizers): Shall be easily cleanable and cleaned thoroughly daily. Grinder heads and Chopper Cutting Rollers shall be kept refrigerated at a temperature not to exceed 500 F when not in use. (f) Mechanical Meat Slicers: Shall be easily disassembled for complete and thorough cleaning each day. (g) Shelves. Counters, Cases. Drawers, Bins, Tables, Show Cases and all other fixtures: Shall be constructed so as to be easily cleanable with no open seams, shall be —3— self - draining, shall not be rusted or otherwise corroded. Shall be clean --no newspapers or other unclean paper shall be used as shelf covering. Item 10. Cleaning Facilities: Facilities must be provided on the premises for the proper cleaning of all containers, utensils, and equipment used in the processing, storage or sale of meat or meat products. Such facilities shall include a two - compartment sink, or a one- compartment sink with dra.inboard and a rinse spray attachment, equipped with hot and cold water under pressure. In new food stores and markets cleaning facilities must be located in the store or market. Facilities shall consist of a two - compartment sink with drainboard.' Sink compartments shall be of adequate size to accommodate the largest piece of equipment or utensil. The sink shall be provided with hot and cold water under pressure to each compartment. (b) Cleaning: All containers, utensils and other equipment which come in contact with the processing of meat or meat products shall, after each days use, be thoroughly cleaned and effectively subjected to an approved bactericidal process inmed.iately following the days operation. Item 11. Liquid Wastes: (a) All liquid wastes including water from air con- ditioning and refrigeration devices shall be discharged into sanitary sewers or into a sewage disposal system which has been approved by the City Health Officer. (b) : Garbage and meat scraps shall be storelpending removal in water- tight metal containers provided with tight fitting covers, so as to be properly protected from insects and animals. Contents of cans shall be removed as often as necessary and receptacles shall be washed when emptied and treated with disinfectant if necessary to prevent nuisance. (e) Trash shall be stored in suitable receptacles pending removal in such a manner as not to become a nuisance. Item 12. Refrigeration: (a) 111 readily perishable foods shall be stored or dis- played at a temperature not to exceed 500 F. (b) 111 refrigerators shall be provided with a thermometer placed in the warmest part of refrigerator in a position so that it may be easily read. Food shall not be stored on floors of walk -in coolers. (c) Refrigerators, Ice Boxes and Cold Storage Rooms: Shall be kept clean and free from rust, fungus growth, molds and slime. Meat hooks shall be of the removable type, clean and free from rust. Refrigerators shall be self - draining and drains shall be trapped into sanitary sewer or caught in suitable containers inside food store or market. Item 13. Display and Storage of Food and Meats: (a) Food and meat displays shall be protected from flies, vermin, depredation and pollution by rodents, unnecessary handling and droplet infection. No animals or fowls shall be kept or allowed in any room in which -.4t Y A i food or meat is processed or stored. be used. (b) All necessary means for the elimination of flies, roaches and rodents shall (c) Sidewalk or street display of foods is prohibited. Food must not be stored in any basement, room or receptacle that is subject to sewage or waste water backflow, or in any place having defective drain pipes or appliances. All bulk goods in sacks or boxes, such as flour, sugar, salt,sornmeal or other similar products, shall not be stored directly on the floor, but shall be placed on racks so that they are held at least 12 inches above the floor. Milk must be sold in original individual containers. Bottle milk or milk products if stored in water shall be stored so that the tops of the bottles will be at least two inches above the water level. Milk packaged in paper tartans and poultry must not be stored in water. Item 3.4. Buiildi�: Shall be of solid construction and in good repair. Item 15. Cleanliness of Employees: (a) All employees shall wear clean outer garments and keep themselves clean while working in any food store or market. (b) Spitting in food stores and markets is prohibited. Use of tobacco in any form in markets is prohibited. Item 16. Health Certificates: All employees shall obtain health certificates from the Little Rock Health Department as required in City Ordinance #6842. Item 17. Living Quarters: None of the operations connected with a food store or market shall be conducted in any room used as living or sleeping quarters, except where clean- ing facilities are located in kitchens of present stores, they shall be acceptable; provided, all other requirements of this ordinance are complied with. Item 18. Premises: The premises connected with or used by any food store or meat market must be kept free from accumulations which favor fly or mosquito breeding or the harboring of vermin and must be maintained in a neat and clean condition. SECTION 6. Disease Control: No person who is affected with any disease in a communicable form or is a carrier of such disease shall work in any food store or market, and no food store or market shall employ any such person or any person suspected of being affected with any disease in a communicable fo= -,or being a carrier of such disease. If the manager suspects that any employee has contacted any disease in a communicable form or has become a carrier of such disease, he shall notify the health officer immediately. A placard con- taining this section shall be posted in all toilet rooms. SECTION 7. Procedure When Infection Suspected: When suspicion arises as to the possibilities of transmission of infection from any grocery or market employee, the health -5- officer is authorized to require any or all of the following measures: 1. The immediate exclusion of the employee from all food establishments. 2. The immediate closing of the food store or market concerned until no further danger of disease outbreaks exists in the opinion of the health officer. 3. Adequate medical examination of the employee and of his associates, with such laboratory examinations as may be indicated. SECTION 8. Penalti®s: Any person who violates any provision of this ordinance shall be deemed guilty of a misdemeanor, and upon conviction thereof shall be fined not less than $10.00 nor more than $100.00., Each and every violation of the provisions of this ordinance shall constitute a separate offense. SECTION 19. Unconstitutionality and Emergency Clause: Should any section, paragraph, sentence, clause, or phrase of this ordinance be declared unconstitutional or invalid for any reason, the remainder of said ordinance shall not be affected thereby. Unless the provisions of this ordinance are placed in effect immediately, the health and safety of the citizens of Little Rock will be affected adversely whereby an emergency is declared to exist and all provisions of this ordinance are hereby in effect from and after the passage hereof.
