ORDINANCE N0. 9531
AN ORDINANCE AUTHORIZING ARKANSAS PaM & LIGHT COMPANY TO DISCONTINUE THE
DISTRIBUTION OF STEAM HEAT SERVICE IN THE CITY OF LITTLE ROCK; TO ABANDON
ITS UNDERGROUND STEAM HEAT DISTRIBUTION SYSTEM; AND FOR OTHER PURPOSES.
WHEREAS, Arkansas Power & Light Company and its predecessor com-
panies, with the authority, consent and approval of the City of Little Rock,
have owned and operated a steam heat distribution system in and under various
streets and alleys in the City of Little Rock, and have from said steam heat
distribution system sold and delivered steam heat service to the City and
residents thereof; and
WHEREAS, practically all of the establishments situated along said
steam distribution system have.provided their own means of developing heat for
their respective uses and are no longer supplied with heating service from the
system now operated by the Arkansas Power & Light Company; and
WHEREAS, the prevailing steam heat distribution system is old, obso-
lete and so worn that it can no longer efficiently serve the public needs and
the thirty -three customers now receiving steam heat service cannot economically
afford to pay the cost of the installation of a new system; and
WHEREAS, the City of Little Rock is now proposing to build a modern
system of travelways leading to and from both the Main Street and Broadway Bridges
across the.Arkansas River, and some of the old steam heat system will have to be
removed from the present location at considerable cost; and
WHEREAS, it is the Dpinion of the Little Rock City Council that the
Arkansas Power & Light Company should be authorized to discontinue the operation
of its steam heat distribution system at the end of the 1953 -54 heating season;
NOW, THEREFORE, BE IT ORDAINED BY THE LITTLE ROCK CITY COUNCIL:
Section 1. Arkansas Power & Light Company be and it is hereby author-
ized and directed to discontinue the operation of its steam heat distribution
system in the City of Little Rock at the end of the 1953 -54 heating season.
Section 2. At the end of the 1953 -54 heating season the Arkansas
Power & Light Company is authorized and directed to remove any and all of its
pipes and conduits in and under streets and alleys which presently form an ob-
struction or hazard to public ways, and said Arkansas Power & Light Company is
hereby authorized and permitted to abandon and leave such conduits in and under
such streets and alleys which do not presently constitute an obstruction or
hazard to the said streets and.alleys.
Section 3. All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
Section 4. Because it is necessary to immediately improve and
relocate the streets and alleys of the'City of Little Rock, and the elimina-
tion of the present steam heat distribution system will make it possible for
the City to improve said streets and alleys to protect the public peace,
health and safety, an emergency is declared to exist and this ordinance shall
be in full force and effect from and after its passage.
