9548ORDINANCE NO. 9548 AN ORDINANCE AMENDING ORDINANCE NO. 8506 TO PROVIDE THAT THE CIVIL SERVICE COMMISSION MAY MAKE FUTURE PROMOTIONS AND EMPLOY- MENT IN THE FIRE AND POLICE DEPARTMENTS ON A PERMANENT BASIS SUBJECT TO THE RIGHTS AFFORDED BY STATE AND FEDERAL LAWS TO A FORMER EMPLOYEE RETURNING FROM MILITARY SERVICE, AND FOR OTHER PURPOSES. WHEREAS, due to the international situation in 1950, caused by the Korean Conflict, the Civil Service Commission deemed it necessary to declare an employment emergency to exist, and WHEREAS, said Commission ordered all promotions and vacancies frozen at the expira- tion of the then effective eligible lists so that promotions in the Fire and Police Departments since that time have been on a temporary promotion basis, and WHEREAS, there are still city employees in the Military Service and, WHEREAS, said temporary promotion basis is now causing uncertainty and confusion in the ranks of the Fire and Police Departments, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That the Military Leave of Absence and Employment Policy as estab- lished by the Civil Service Commission on November 2, 1950 and subsequently approved by this Council in Ordinance No. 8506, passed November 6, 1950 be hereby amended to read as follows: (a) "That any city employee who has satisfactorily completed six months of continuous service, shall upon submitting proof of enlistment or induction into the armed forces of the United States, be granted a Military Leave of Absence, and upon proper application for restoration of employment, made not later than ninety (90) days from the date of honorable discharge from the Armed Forces and upon satisfactory proof of physical and mental fitness, shall be reinstated in the same rank or position in which he or she left, with seniority credited for the time served in the Armed Forces. If, however, said employee was on one of the present effective eligible lists for promotion, and if during the period of said employeets Military Leave of Absence a vacancy occuAbid before the expiration of the list on which his posi- tion would have entitled him the promotion, the employee shall be immediately promoted. (b) "That all promotions and vacancies in the Non - Uniformed employees group shall be frozen at the expiration of the present effective eligible - lists; and thereafter, any promotion or vacancy shall be filled on a temporary basis, PROVIDED, that the Commission may fill any promotion or vacancy on a permanent basis, if the Commission determines that there is no eligible city employee on Military Leave of Absence to the Armed Forces. (c) "That future promotions and employment in the Fire and Police Depart- ments may be made on a permanent basis, subject to the rights afforded by State and Federal laws to a former employee returning from Military Service. (d) "That employees granted Military Leave of Absence and that new persons employed shall be notified in writing by the Civil Service Commission of their Civil Service Status and these policies of the Commission. -2- (e) "That these policies shall be in force and effect retroactive from July 31, 1950, the date the first employee was called into the Armed Forces, until such time as the Civil Service Commission deems it to the best interest of all concerned to declare this emergency terminated. (f) "That these policies are established in order to assure city employees equitable employment status upon their reinstatement from service in the Armed Forces; however, it is understood that circumstances will alter cases and that the Civil Service Commission may, at their discretion, change said policy as herein set forth." SECTION 2.
