9639ORDINANCE NO. 9639 AN ORDINANCE TO REGULATE THE BULK SYSTEM OF HAMLING, STORAGE, AMID TRANSPORTATION OF NLCLK FROM 1,AlfMS TO PLANTS, AND r'UR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE r,'OCK, ARKANSAS: SECTION 1. In addition to meeting all applicable require- ments, as provided for in Ordinance No. 7023 and all amendments thereto, for the handling, storage and transportation of Grade A raw milk from farms to plants, the following additional re- quirements shall be met by those using the bulk system of handling, storage, and transportation of milk. SECTION 2. Milk Room Facilities. A. A thirty- gallon water heater shall be provided when the milk storage tank is of 300 - gallon capacity or less, and a fifty - gallon water seater shall be provided when the storage tank is of a larger capacity. B. There shall be a water connection line adjacent to, or immediately convenient to, the milk stor- age tank supplied with a short length of flexible hose for use in rinsing the storage tank with tepid z,.ater. Hose racks shall be provided for storage of water hoses when not in use. C. The milk conductor opening shall be located in the milk house or milk room nearest the normal loading position of the milk transport tank. The opening shall be not more than 6 inches in diame- ter and located not less than 8 inches above the floor, and shall be equipped with self - closing covers, and shall drain to the inside of the milk room. D. When electricity is the motive power for the milk transport tank milk pump, an electrical connection, of approved safety type, shall be provided near the milk conductor opening. f -2- E. The milk room shall be of a size than an 18 -inch clearsnce of the tank and its appurtenances from the walls and at least the same distance from other machinery, equipment-or facilities, shall be provided. SECTION 3. Milk Storage Tank. A. Construction. Type, construction and size of the bulk milk storage tank shall meet approval of the Health Officer. The bulk milk storage tank shall be so located that the floor dranin is accessible for clean- ing. The outlet of the tank shall be protected by a sani- tary cap at all times except during the unloading operation, and when necessary for cleaning and in- spection. The measuring device shall comply with the sanitation specifications of the 3 A Sanitary Stand4rds. B. Size of Bulk Milk Storage Tanks. It is recommended that bulk milk storage tanks be of a size equal to at least 150' of estimated largest daily production. In case of an emergency a tank of this capacity should accommodate tl-e storage of three complete milking operations, or additions to the milking herd not presently contemplated. If tre herd production becomes such that the farm bulk milk storage tank would be filled beyond capacity, such surplus milk shall not be collected by the bulk milk transportation tank operator, nor shall such surplus milk be received at a milk plant or milk receiving station holding Little Rock Health Department Milk plant or milk receiving station permit unless all requirements for production, cooling and storage of Grade A raw milk in cans are complied with. -3- C. Milk Conductor. For conducting milk from the farm tank to the transport tank a non -toxic type tubing may be used. The mini- mum inside diameter of the tubing shall be at least 1 3/8 inches and length not to exceed 8 feet. The maximum length for each complete conductor unit shall not exceed 16 feet. The sections shall be joined by the use of sanitary demountable fittings which shall be disconnected only for inspection or cleaning. The fitting that attaches the milk conductor to the farm bulk tank shall be provided with a sanitary protective cap kept in place when the conductor is not used for conducting milk or • during cleaning operations. D. Cleaning and Sanitizing of Bulk Milk Tanks. A definite procedure for cleaning and bactericidal treatment of milk contact surfaces of all farm milk equipment shall be followed at each farm using bulk milk storage tanks. Milk plants receiving the milk from farms using bulk tanks shall furnish copies of the cleaning procedure which shall be posted in a conspicuous place on an inside wall of the milk house or milk room of each producer participating in the bulk milk program. The procedure shall be as follows: 1. The farm storage tank shall be rinsed with tepid water and the agitator removed from the tank for washing. This shall be done by the transport tank driver immediately after the tank is emptied. Note: It is advisable that tepid water (80 -90 F) be used for rinsing the tank. This will assist in driving refrigerant gas into the compressor and renders the milk contact surface ready for the hot wash solution. It is also understood that the refrigerating 'unit must be shut off during the washing operation. 2. The cleaning operations shall follow without unenecessaryy delay., by brush washing all utensil surfaces with hot (120 -130 F) detergent solution and rinsing with hot water. -4- 3. All equipment pert to the milk storage tank such as agitator, draw -pipe, outlet valve, measuring device and related equip- ment, shall immediatley after washing, be placed in their respective positions in the storage tank until the next use. 4. All milk contact surfaces shall be given an approved bacteri- cidal treatment just immediately before use. 5. The protective cap at the bottom outlet shall be loosened after sanitizing to permit drainage of any solution which may have collected. SECTION 4- Cooling of Milk. Milk shall be cooled to 50 F or less within one hour after the milking of the herd is completed and to 40 F within 2 hours after milking and shall be maintained at 40 F or less until delivered. SECTION 5. Farm Bulk Milk Transportation Tank Operator. A. (qualifications and Duties. 1. The transportation tank operator shall be qualified to carry out methodes necessary for the sseptic collection of milk samples and the sanitary transfer of milk from the farm storage tank to the transport tank. He must also be able to distinguish non - conforming milk by sight or smell, since with him rests the decision to reject or accept the milk. 2. Non - conforming milk shall not be added to the bulk milk storage tank. The milk transport operator shall observe and check the milk for non - conformity before pumping to the tank truck. The supply of milk shall be rejected if evidence of non - conforming milk is observed. Non - Conforming milk is milk which is bloody, stringy, or indicates mastitis or other diseased condition, or which was not cooled immediately after milking to 50 F or less within one hour after milking or which has not been maintained at a temperature of 50 F or less until collection. ob -5- 3. The milk transport operator shall be of clean, tidy personal habits and shall wear clean outer clothing:, preferably of light color. He shall wash his hands thoroughly just before handling milk contact equipment on each farm. 4. Rulti -use milk contact equipment such as sampling devices shall be thoroughly washed and sanitized before each use. 5. ?rdhen making the duplicate weigh sheets, showing the date and producer's name, he shall also record the temperature of the milk in the tank. 6. Immediately upon unloading the milk storage tank, he shall rinse the tank of milk solids wit, tepid water and remove the agitator. Frozen milk if present shall be removed. 7. He shall complete the milk collection route with the least amount of delay. Because of the responsibility of his position, no person shall be employed as a farm bulk milk transport operator until his qualifications have been examined and approved by the Health Department. He shall make application to the Health Department for examination of qualifications relating to his duties, sub- mit to such examination and obtain written authorization before assuming such duties. This authorization may be witl_ drawn by the Health Department for any willful or deliberate attempt by the applicant to circumvent or otherwise hinder the application of these re- gulations, after a hearing by the Board of Health. SECTION 6. Bulk Milk Transportation Tanks, A. Permits. Any person contemplating transportation of bulk farm milk from the dairy farm to a milk plant or milk receiving station shall first obtain a bulk farm milk transport permit from the Health Department. B. Specifications. 11ilk transportation tanks for transporting milk from farms to plants shall comply ,pith the specifications of the United States Public Health Service Standard Milk Ordinance and Code with reference to the utilit;r, construction, cleaning and bactericidal treatment, the use of identification taCs in?icat no such treatment, and in �.C(34tion, t' e riilk t ^arsp o_rt wall be equipped wit! -, : 1. A tight, insulated cabinet, the inner surfaces of stain- less steel construction, of ample size and structure to provide storage of all equipment used for milk handling purposes, such as pump milk conductors anc sampling equipment. 2. A refrigerated separated compartment for storage of samp- les. C. Unloading of Flilk, bilk from the transport tank shall be un- loaded in a place and in a manner ;:hick will prevent the conta- mination of the product during the operations. 1. Unloading of the milk may be performed by the use of equipment similar to that used in he loading the tank. The same type flexible tubing or stainless steel tubing may be used. The unloading platform shall be of concrete and graded to drain, and ,-he location shall be approved by the 'ealth Officer. 2. Farm bulk milk transportation tanks used to transport successive loads of milk from farms to milk plants or milk receiving stations shall be required to be cleanad and bactericidally treated, after the removal of each successive load. SECTION 7. Permits. A. Producers Holding Health Department Permit. A producer al- ready holding a Health Department permit, desiring to handle milk according to the bulk system shall first make application to the health Department and shall show evidence of satisfactory -7- production of Grade A raw milk as shown by the last four tests. No producer shall install a bulk tank unless authorized in writ- ing by the Health Officer. B. Only farm bulk milk transportation tanks holding a Health Department farm bulk milk transportation tank permit shall be allowed to trans- port milk from a milk producer holding a Health Department milk plant permit. C. The acceptance of milk from sources not authorized which is deli- vered to a plant holding, a Health Department milk plant or milk receiving station permit shall be cause for revocation of the farm bulk milk transportation tank permit. SECTION 8. Milk Plant Responsibilities, A. The milk plant shall be responsible for the rejection of non - conforming milk into the plant. B. At least bi- weekly and as often as otherwise directed by the Health Department a sample of milk from each farm storage tank shall be collected by a plant -representative. The milk samples shall be examined bacteriologically in accordance with the current edition of Standard Methods of Milk Analysis. All samples shall be collected aseptically. C. Provision shall be made for the proper storage and refri.- eration of samples between the '-ime of collec:;ion and testing. D. Records of quality tests shall be held in the plant riles at least 90 days and shall be made available to the Health Department u.;c_. request. E. Suitable facilities including hot and cold running water, a concrete floor with proper drainage and waste. Disposal shall be provided for washing and sanitizing transportation tanks, tubing and accessories. SECTION 9. Upon the conviction of any person, firm or corporation for violat- ing any provisions of this Ordinance, they shall be subject to a minimum fine of $25.00 and a maximum of $100.00. That each day shall be considered a separate offense. ,c 1 -8- SECTION 10.
