9874ORDINANCE NO. 9874 AN ORDINANCE AUTHORIZING THE MAYOR AND CITY CLERK TO EXECUTE AND ENTER INTO AN AGREEMENT WITH THE BIG ROCK STONE & MATERIAL COMPANY, WHEREBY THE CITY OF LITTLE ROCK AGREES TO PAY THE COST OF RELOCATION AND RECONSTRUCTION OF CERTAIN BUILDINGS AND FA CI LI TIES OF THE BIG ROCK STONE & MATERIAL COMPANY IN ORDER TO CLEAR THE RIGHT -OF -WAY FOR THE RIVERFRONT DRIVE, AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That the Mayor and the City Clerk are hereby authorized and requested to execute and enter into an Agreement with the Big Rock Stone & Material Company, whereby the City of Little Rock agrees to pay the cost of relocation and reconstruc- tion of certain buildings and facilities of the Big Rock Stone & Material Company, which are now located in the proposed right -of- way of the Riverfront Drive, in order to clear the right -of -way for the Riverfront Drive. SECTION 2. That the form of such Agreement shall be as fol- lows: A G R E E M E N T THIS AGREEMENT by and between the CITY OF LITTLE ROCK, here- inafter referred to as "City ", acting by and through its Mayor and City Clerk, and BIG ROCK STONE & MATERIAL COMPANY, hereinafter re- ferred to as "Company"; WI TNESSE TH : WHEREAS, the City proposes to construct a street known as "Riverfront Drive "; and WHEREAS, said construction necessitates the acquisition by the City of certain property occupied by the Company; and WHEREAS, such acquisition will require the relocation and re- construction of certain buildings and facilities of the Company, and the parties desire to agree upon the method of determining the damages sustained by Company; NOW, THEREFORE, the parties hereto agree as follows: 1. The parties recognize that the construction of the River- front Drive necessitates the following corrective work on the premises occupied by the Company: e -2- (a) The existing garage on the premises must be moved from its present site to another site on the premises. (b) The present repair shop must be demolished. (c) The present machine shop must be moved to a new location on the premises for use as a,repair shop. (d) A new machine shop must be provided but cannot be located on the affected premises. A building owned by the Company on its premises in North Little Rock will be moved to the Company's premises on the Arch Street Pike for this purpose. (e) The present scale pit must be relocated on the premises and a new scale house provided. (f) The sand and gravel bins must be modified to accom- modate the changed traffic pattern on the Company's premises. (g) Approximately 250 feet of railroad track must be relocated and 60 feet of additional track provided, together with necessary appurtenances. 2. The Company agrees to perform the above work and the City agrees to pay to the Company all costs incident to performance thereof, including an allowance of 15% of said costs in lieu of any allowance for supervision and overhead; provided, however, that said sum shall in no event exceed the sum of Seventy -three Thousand, Three Hundred Thirty -four Dollars ($73,334.00). An approximate estimate of costs, by items is attached hereto, marked "Exhibit A", and made a part hereof. 3. The Company periodically shall render itemized statements of its costs to the City, and the City agrees to reimburse the Company for such costs incurred on or before the 25th day of any month on or before the 10th day of the following month. It is agreed and understood that the Company may make such subcontracts with in- dependent contractors as it deems advisable in expediting the work to the best interest of all concerned. 4. In addition to the payment of the costs of work as outlined above, the City agrees that it will fill, or cause to be filled$ the area known as the Boathouse property immediately East of the premises -3- now occupied by the Company to the same grade as the roadbed of the Missouri - Pacific Railroad tracks adjacent thereto, and as shown on the State Highway Department drawing described in Paragraph 6 hereof. 5. The State Highway Department plans and specifications for the project include construction of a retaining wall immediately north of the north railroad right -of -way line and parallel thereto. It is contemplated that such work will be performed by the Company on a force account basis, but it is impractical to estimate the cost of this work at this time. In addition to all other undertakings of the City herein, the City agrees to reimburse the Company for all costs incident to construction of said retaining wall in ac- cordance with plans and specifications to be furnished by the State Highway Department. 6. This agreement is contingent upon the Cityts procuring an agreement from the State Highway Department that access roads to the Riverfront Drive and pedestrial walks across same will be con- structed substantially as shown on the work drawing prepared by the State Highway Department, entitled as follows: "Job 6429, Little Rock Riverfront Drive, Work Drawing of Proposed Locations Broadway to Main Street, Revised 7/11/55 "• EXECUTED this day of August, 1955.
