10103P ORDINANCE N0. 10.10 AN ORDINANCE VACATING AND ABANDONING THE STREET RUNNING BEMM BLOCK 2, WESTERN HILLS SUB - DIVISION TO THE CITY OF LITTLE 'ROCK AND BLOCK 2, FORSTERIS SUB- DIVISION OF LOT 5, BLOCK 2, HYDE PARK ADDITION TO THE CITY OF LITTLE ROCK, AND ABANDONING AND VACATING THAT PORTION OF AN ALLEY RUNNING THROUGH BLOCK 22, WESTERN HILLS SUB - DIVISION TO THE CITY OF LITTLE ROCK ABUTTING AND ADJOINING LOTS 6 AND'7 OF SAID BLOCK 2, WESTERN HILLS SUB - DIVISION. 11th9 a Petition was duly filed with the City Council of the City of Little Rock, Arkansas on the -9th day of March , 1956s, requesting the City Council to vacate and abandon that portion of Van Buren Street running between Block 20 Western Hills Sub - Division to the City of Little Rock and Block 2, Forsterls Sub - Division of Lot 50 Block 2, Hyde Park Addition to the City of Little Rock, Arkansas, and re- questing the City Council to vacate and abandon that portion of an alley in Block 20 Western Hills Sub - Division to the City of Little Rock, which abuts and adjoins Lots 6 and 7 of Block 22 Western Hills Sub- Division to the City of Little Rock, the said street and alley appearing on the plat of Western Hills Sub - Division and Forster's Sub - Division of Lot 1. 50 Block 29 Hyde Park Addition to the City of Little Rock in Plat Book 1, at page 2500 and Plat Book 4, at page 266, of the records in the office of the Recorder of Pulaski County Arkansas respectively; and, WHEREAS, after due notice as required by law, the Council has, on the day and at the place mentioned in the notice, heard all persons desiring to be heard on the question, and has ascertained that the street and alley hereinabove described have heretofore been dedicated to the public use as a street ti and alley, have not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of the plat, and for a period of at least five (5) years immediately pre - ceeding the filing of the Petition, and the date of the passage of this ordinance; that the sole owners of the property abutting upon said street and alley to be vacated have filed with the Council their written consent to such abandonment; and that the public interest and welfare will not be adversely affected by the aban- donment of such alley. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City of Little Rock, Arkansas hereby releases, vacates and abandons all of its rights, together with the rights of the public generally, except the rights and needs of public utili- ties, for ingress and egress to maintain and construct utility lines over and in said area, and except the rights and needs of the City of Little Rock for ingress and egress to control drainage in said area, in and to the street and alley designated as follows: The street (known as Van Buren Street) running North and South between Block 2, Western Hills Sub - Division of the City of Little Rock, and Block 2, Forsterts Sub- Division of Lot 5, Block 2, Hyde Park Addition to the City of Little Rock, Arkansas, being abutted on its West side by Lots 3 and 4, Block 2, Forsterts Sub - Division of Lot 5, Block 2, Hyde Park Addition, and on the East by Lots 6 and 7, Block 2, Western Hills Sub - Division to the City of Little Rock, and that portion of the alley running East and West through Block 2, Western Hills Sub - Division, which is abutted on the North by Lot 6 and on the South by Lot 7 of said block, said street and alley being reflected in the plat of Western Hills Sub - Division at page 250 of Plat Book 1, and in the plat of Block 2, Forsterts Sub - Division of Lot 5, Block 2, Hyde Park Addition, reflected in Plat Book 4 at page 266, in the records in the office of the Recorder of Pulaski County, Arkansas. If . ._ . Section 2. A copy of the ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of the County and recorded in the deed records of the County. Section 3.
