AN ORDINANCE VACATING AND CLOSING A PART OF
THE PLATTED ALLEY IN BLOCK 2, STRONG & WATERS
ADDITION TO THE CITY CF LITTLE . ROCK, ARKANSAS
WHEREAS, a petition was duly filed with the City Council
of Little Rock, Arkansas, on the 26th day of March, 1956, asking
the City Council to vacate and abandon so much of the alley desig-
nated on the Plat of Block 2, Strong & Waters Addition to the City
of Little Rock, Arkansas, as lies between Lots 10, 11, 12, 13, 14
and 15 in said Block and Addition, said Plat appearing of record in
Plat Book 1 at Page 44 in the office of the Circuit Clerk and Ea-
Officio Recorder for Pulaski County, Arkansas; and
WHEREAS, after due notice, as required by law, the Council
has at the time and place mentioned in the notice, heard all persons
desiring to be heard on the question and has ascertained that the
alley hereinabove described has heretofore been dedicated to the
public use as an alley; that said alley has never been opened and
has never been used by the public at any time; that all owners of
the aforesaid property abutting upon the alley have filed with the
Council their written consent to such.abandonment; that said owners
are Mrs. Mary Bain Sherrill, Dr. Paul L. Mahoney and Mrs. Gladys B.
Mahoney, his wife, the petitioners; and that the public interest and
welfare will not be adversely affected by the abandonment of such
alley;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF LITTLE
ROCK, ARKANSAS:
Section 1. That the City of Little Rock, Arkansas, hereby
releases, vacates and abandons all its rights, together with the
rights of the public generally, in and to the alley designated as
follows:
That part of the platted alley in Block 2, Strong &
Waters Addition to the City of Little Rock, Arkansas,
which lies between Lots 10, ll, 12, 13, 14 and 15 in
said Block and Addition, as shown by the Plat of
record in Plat Book 1 at Page 44 in the office of the
Circuit Clerk and Ea- Officio Recorder for Pulaski
County, Arkansas;
provided, however, anything to the contrary herein notwithstanding,
the City of Little Rock, Arkansas, reserves for itself, and for the
public, a right -of -way almg said alley for any existing utility
services and for any future utility services which may be installed
by the City ar by any public utility to serve the public, and
neither the City nor any public utility shall be liable in damages
by reason of the construction, maintenance or repair of said public
utility services,
Section 2. That a copy of this ordinance, duly certified
by the City Clerk, shall be filed in the office of the Circuit Clerk
and Ex- Officio Recorder for Pulaski County, Arkansas, and recorded
in the Deed Records of the County.
Section 3. That this ordinance shall take effect and be
in force from and after its passage.
