AN ORDINANCE CLOSING AND VACATING THE DEDICATED
ALLEY LOCATED IN BLOCK EIGHT (8), ADAMS ADDITION
TO THE CITY OF LITTLE ROCK, ARKANSAS; AND FOR
OTHER PURPOSES.
Whereas# a petition was duly filed with the City
Council of the City of Little Rock, Arkansas, on the 6th
day of April, 1956, asking the city council to vacate and
abandon the alley located in Block Eight (8) designated on
the plat of Adams Addition to said city, now appearing of
record in Deed Book 21, at page 622, in the office of the
Recorder of Pulaski County, Arkansas, and.
Whereas after due notice as required by law, the
council has, at the time and place mentioned in the notice,
heard all persons desiring to be heard on the question and
has ascertained that the alley hereinbefore described, has
heretofore been dedicated to the public use as an alley; has
not been actually used by the public generally for a period of
at least five (5) years subsequent to the filing of the plat;
that all the owners of the property abutting upon said alley
to be vacated have given their written consent to such abandonment
by joining in and signing the petition; and that public interest
and welfare will not be adversely affected by the abandonment
of such alley.
NOW,THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF LITTLE ROCK, ARKANSAS:
Section le The City of Little Rock, Arkansas, hereby
releases, vacates and abandons all of its rights, together
with the rights of the public generally, except the rights and
needs of public utilities for ingress and egress to maintain
any existing utility lines in said area, and except the rights and
needs of the City of Little Rook for ingress and egress to
control drainage in said area, in and to the alley designated
as follows:
The dedicated alley located in Block 8, Adams
Addition to the City of Little Rook, Arkansas
as shown by the Plat and Bill of Assurance on
file in Deed Book 219 page 6229 in the office
of the Recorder of Pulaski County, Arkansas,
Section 2. A copy of this ordinance duly certified by
the city clerk shall be filed in the office of the Recorder of.
Pulaski County, Arkansas, and recorded in the deed records of
the said county.
Section 3. This ordinance shall take effect and be in
force from and after its pagsagee
