AN ORDINANCE VACATING AND ABANDONING A STRIP OF
LAND 25 FEET 'HIDE DEDICATED AS A STREET ON THE
SOUTH SIDE OF WESTOVER HILLS SUBDIVISION, PULASKI
COUNTY, ARKANSAS, FROM THE WEST LINE OF LOT 1;
EXTENDED SOUTH, of WESTOVER HILLS SUBDIVISION,
TO A POINT 572,8 FEET DUE EAST OF SAID WEST LINE,
AND FOR OTHER PURPOSES$
WHEREAS, a petition was duly filed with the City Council
of the City of Little Rock, Arkansas, on the 9th day of April, 1956,
requesting the City Council to vacate and abandon a strip of land
25 feet in width from the west line, extended South$of Lot 1,
Westover Hills Subdivision, Pulaski County, Arkansas, to a point
572.8 feet due east of said west line, extended south,of said Lot
1, which strip of land was dedicated as a street in the plat of
Westover Hills Subdivision, Pulaski County, Arkansas, now appearing
in Plat Book 4, page 89, in the Pulaski County Recorderts office; and
ITHEREAS, after due notices as required by law, the Council
has, on the day and at the time and place mentioned in the notice,
heard all persons desiring to be heard on the question, and has
ascertained that said portion of said street, hereinbefore described,
has heretofore been dedicated to the public use as a street; has
not been actually used by the public generally for a period of at
least five years subsequent to the filing of the plat, and for a
period of at least five years immediately preceding the filing of the
petition and the passage of this ordinance, or any time since it
was platted; that said strip of land was dedicated wholly from lands
platted as Westover Bulls Subdivision and that no part of said strip
of land was dedicated or taken from the lands in Kavanaugh Place
Addition which abut said strip on its south side; that the owners
of lands in Kavanaugh Place Addition to the City of Little Rock,
Arkansas, have no right, title and interest in and to any portion of
said strip of land; that all of the owners of property in Westover
Hills Subdivision abutting upon the north side of said portion of
said street to be vacated have filed with the Council their written
consent to such abandonment and have signed the petition for said
abandonment; and that the public interest and welfare will not be
adversely affected by the abandonment of said street;
NOW, THEREFORE, BE IT ORDAINED by the City Council of
the City of Little Rock, Arkansas:
SECTION 1. The City of Little Rock, Arkansas, hereby
releases, vacates and abandons all of its rights, together with
the rights of the public generally, except the rights and needs
of public utilities, including the Little Rock Municipal Waterworks,
for ingress and egress to maintain any existing utility lines, in-
cluding water lines, in said area, and except the rights and needs
of the City of Little Rock for ingress and egress to control drain-
age in said area, in and to the street designated as follows:
A strip of land 25 feet in width from the west line, -
extended south; of Lot 1, Westover Hills Subdivision,
Pulaski County, Arkansas, to a-point 572.8 feet due east of
said west line, extended south, of said Lot 1, which strip
of land was dedicated as a street-in the plat of Westover
Hills Subdivision, -Pulaski County, Arkansas, now appear-
ing in Plat Book 4, page 89, in the office of the Circuit
Clerk and Ex- Offioi.ir$ecorder of Pulaski County, Arkansas.
SECTION 29 A copy of this ordinance duly certified by
the City Clerk of this City shall be filed in the office of the
Recorder of Pulaski County, Arkansas, and recorded in the deed
records of said county.
SECTION 3. This ordinance shall take effect and be in
force from and after its passage.
