Ail ORDINANCE TO P:1RMIT THE CONS` RUCTION, OPERATICIV AND MAINTENANCE
OF A Sa- UR TRACK UPON THE MISSCURI PACIFIC RAILROAD COMPANY RIGHT -
OF -WAY SITUATED CN ASHLR AVENUE IN T'!E CITY OF LITTLE ROCK, ARKAN-
SAS AT APPR CXIMATELY THE 4700 BLOCK.
WHEREAS, a Petition was duly filed with the City
Council of the City of Little Rock, Arkansas, on the 6th
day of August, 1956, requesting that the City Council authorize
and permit it to lay, construct, operate and maintain a spur
tract upon the right -of -way owned by the Missouri Pacific Rail-
road Company extending across Asher Avenue in the City of Little
Rock, Arkansas, for the purpose of serving property owned by
Joseph W. 1ann,- et al., said property being located in the
SEI NEI Section 1$, Township 1 North, Range 12 Vvest and lying
immediately south and adjacent and contiguous to Asher Avenue.
And,
' dEREAS, after due notice as required by law the
Council has at the time and place so designated heard all
persons desiring to be heard on the question and has ascertained
that the public welfare will not be adversely affected by the
construction, operation and maintenance of a spur tract upon the
Missouri Pacific right -of -way as hereinabove described.
NOW, THEREFORE, be it ordained by the City Council
of the City of Little Rock, Arkansas:
SECTION I. The Missouri Pacific Railroad Company,
its successors and assi =ns is hereby authorized and permitted
to lay, construct, operate and maintain a spur track upon the
Missouri Pacific Railroad Company right -of -way situated near
the 4700 Block of : ;sher Avenue in the City of Little Rock, Ark -
aneas, said spur tract to be in addition to the one presently
existing upon said right -of -way and said spur tract to serve
certain properties owned by Joseph W. Mann, et al and lying
immediately south of and contiguous and adjacent to Asher Avenue.

SECTION II. The Missouri racific Railroad Company
in the laying of said spur tract is at its own expense to con-
form to the grades which have been fixed or which may hereafter
be fixed by the City Council of the City of Little Rock.
SECTION III. This Ordinance takes effect and shall
be in force and effect from and after its passage.
