10350T ; I"-." ORDINANCE NO. 10.350 AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF "0" STREET IN THE CITY OF LITTLE ROCK, ARKANSAS. WHEREAS a petition was duly filed by B. F. Vinson and Robert L. Baird and Lelia B. Baird, his wife, with the City Council of the City of Little Rock, Arkansas, on the 12th day of November, 1956, asking the City Council to vacate, abandon and close all that portion of "0" Street in the City of Little Rock, Arkansas located between Lot Two Hundred Thirty -One (231), Prospect Terrace No. 3, an Addition to the City of Little Rock, Arkansas, and Lot Five (5), Block Twenty -Nine (29), Mountain Park Addition to the City of Little Rock, Arkansas, designated on the plat of Prospect Terrace No. 3, an Addition to the City of Little Rock, Arkansas, now appearing of record in Plat Book 3 at page 52, and on the plat of Mountain Park Addition to the City of Little Rock, Arkansas, now appearing of record in Deed Record Book 80 at page 86, all in the office of the Recorder of Pulaski County, Arkansas, and as more particularly described herein- after; and WHEREAS after due notice as required by law, the Council has, at the time and place mentioned in the notice, heard all persons desiring to be heard on the question and has ascertained that the portion of "0" Street, hereinafter described, has heretofore been dedicated to the public use as a street herein described; has not been actually used by the public generally for a period of at least five (5) years subsequent to the filing of said plats; that petitioners are the only abutting landowners upon the portion of the street to be vacated and, accordingly, all abutting landowners have consented to such abandonment; and that public interest and welfare will not be adversely affected by the abandonment of such street. NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Little Rock, Arkansas: Section 1. The City of Little Rock, Arkansas, hereby releases, Page 2 vacates and abandons all its rights, together with the rights of the public generally, but excepting any easements now in effect for utility lines, specifically including that of the Little Rock Munici- pal Water Works, in and to the street designated as follows and upon said plats, certified copies of which are filed with the City Clerk: That portion of "0" Street adjacent to and abutting the South.boundary line of Lot 5, Block 29, Mountain Park Addition to the City of Little Rock, Arkansas, located between said Lot 5, Block 29, Mountain Park Addition to the City of Little Rock, Arkansas, and Lot 231, Prospect Terrace No. 3, An Addition to the City of Little Rock, Arkansas, and more particularly described as: Begin at the Southeast corner of Lot 5, Block 29, Mountain Park Addition to the City of Little Rock, Arkansas; thence West along the South boundary line of said Lot 5 to the South- west corner of said Lot 5; thence South at a 900 angle to the South line of said Lot 5 to a point on the North line of Lot 231, Prospect Terrace No. 3, An Addition to the City of Little Rock, Arkansas; thence East along said North line of said Lot 231 to the Northeast corner of said Lot 231, said point being the inter- section of the South right -of -way line of "0" Street and the West right -of -way line of Wildwood Road; thence in a northerly direction to the point of beginning. Section 2. An eight foot easement in said portion of "0" Street is specifically retained for the location of a 16" water line by the Little Rock Municipal Water Works, the center line of which eight foot easement shall lie along said pipe line in its present loca- tion. This easement is retained for the purpose of providing ingress and egress to permit maintaining, repairing, or replacing said water line and so that no structures may be placed over said water line. Section 3. A copy of this ordinance duly certified by the City Clerk shall be filed in the office of the Recorder of Pulaski County, Arkansas, and recorded in the Deed Records of said County. Section 4. This ordinance shall take effect and be in force from and after its passage. w Page 3 Section 5. All ordinances or parts of ordinances in con- flict herewith are hereby repealed.
