has a dedicated right -of -way width of 40 ft. and
4 vn— ALAS, Jrdinance No. 3939 provides that a dedicated
right -of -way of 40 Ft. should have a 24 ft. street and
vviiEhLAS, upright Avenue between mice and Denison streets
has previously been widened to a 34 ft. street so that the side-
walks average only 3 ft. in width, and
a4r;EFt -AS, Any further widening of 4right Avenue in this
block would have to be done on private property, and
9viiLr'ZAS, The additional widening would be to the public
benefit, and
rVtiihGAS, The owner of the property fronting on the South
side of jright Avenue beginning with the East side of Lice
street and extending Eastward for a distance of 82 ft. desires
to set the curb line inside of his own property so that o4right
Avenue at this location would be 40 ft. in width, 17 ft. from
the center line to the North, and 23 ft. from the center line
to the South, and also a 4 ft. side -walk, and
4uHEiit£AS, This additional set back on the South side of
vrright Avenue would provide for off street parking.

SECTION 1. That the South curb of rdright Avenue from nice
;"treet Last for a distance of 32 ft. be set back to a point of
23 ft. from the center line of vvright Avenue, so as to provide
off street parking, and also a 4 ft. side -walk, provided however,
that the City shall not bare any of the expense of moving said
curb or any utility relocation necessary, and further that the City
assumes no obligation to pave that portion of vdright avenue herein
described.
SECTION 2. The City Engineer of the City of Little Hock
is hereby authorized and directed to issue appropriate permits
for the aforesaid work.
SEC.TiON 3. That Ordinance No. 3939 insofar as it pertains
to the width of uuright Avenue at this location that is set out
.t... - -irf Section 1, is hereby repealed and all ordinances and parts
of ordinances in conflict are hereby repealed.
SLOT ON 4. Ahlereas, that the completion of the aforesaid
work, i4t ight Avenue will be substantially widened and the parking,
area thereon made. larger without detriment to traffic on ivright
Avenue which will be to the immediate benefit of the public
generally, and
the immediate operation of the provisions of this
Ordinance is necessary to provide such relief and same being
necessary for the benefit of the public health, peace, and
safety, and general welfare of the citizens of the City of
Little hock,
NO�q, Ttic:rcrOrtiE, an emergency is hereby declared to exist
and this Ordinance shall be in full force and effect immediately
from and after its passage.
