10348Y ORDINANCE NO. 10,348 AN ORDINANCE ESTABLISHING BUILDING SETBACK LINES ACROSS ALL PROPER- TY ABUTTING ON HAYES STREET SOUTH OF CANTRML ROAD (STATE HIGHWAY #10), REVEALING ORDINANCE NO. 9454, AND FOR OTHER PURPOSES. WHEREAS The Little Rock Planning Commission at a meeting on July 8, 1954 approved the Master Street Plan of the City of Little Rock, Arkansas, and, WHEREAS The City Council of the City of Little Rock at a meeting on July 12, 1954 adopted said Master Street Plan, and, WHEREAS It is now desirable that Building Setback lines be established along certain of the streets or ways shown on said Master Street Plan. NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. Definitions. A building setback line is a line across the full width of a tract or tracts of property abutting upon_ a street or public right -of -way, between which line and the property line of the street there shall be erected no building, pump island, or other structure except sign posts or fences less than four (4t) feet high. The distance specified for a building setback line shall be the minimum distance measured horizontally between said line and the center line of the public right -of -way. SECTION 2. Establishment of Building Setback Line. A. There is hereby established on each side of Hayes Street between Cantrell Road (State F ighway #10) and Markham Street a building setback line of sixty -five (651) feet. B. There is hereby established on each side of Hayes Street between Markham Street and the southernmost city limits line a building setback line of seventy -five (751) feet. SECTION 3. Effect on existing buildings and structures. Nothing herein contained shall be construed as prohibiting the con- tinued occupancy, maintainence, or repair of any non - conforming building or structure legally existing at the effective date hereof. SECTION 4. Enforcement. It shall be the duty of the City Engineer to enforce this ordinance. SECTION 5. Repeal of conflicting Ordinances. All ordinances or parts of ordinances in conflict herewith, especially Ordinance x`9454, are hereby repealed. SECTION 6. Effective date.
