10299ORDINANCE NO. 10,299 AN ORDINANCE VACATING, ABANDONING AND CLOSING PORTIONS OF CERTAIN STREETS AND ALLEYS LOCATED IN GRANITE PARK ADDITION TO LITTLE ROCK, ARKANSAS WHEREAS, the Housing Authority of the City of Little Rock, Arkansas has acquired and is presently the owner of a large portion of Granite Park Addition to Little Rock, Arkansas within which the hereinafter- described portions of streets and alleys are located, as well as acreage located along a portion of the south boundary of said addition, which lands it has acquired in its undertaking of a slum clearance and urban redevelopment pro- ject in the City of Little Rock, Arkansas, designated as Project No. UR ARK 1 -2; and WHEREAS, said Housing Authority of the City of Little Rock, Arkansas proposes to subdivide and replat a portion of the lands it has so acquired, including a portion of Granite Park Addition to Little Rock, Arkansas, in accordance with and as shown by a plat dated September 3, 1955 of Granite Heights Subdivision, a copy of which is filed in the office of the Little Rock City Clerk; and WHEREAS, portions of certain streets and alleys located in Granite Park Addition to Little Rock, Arkansas, all of which are bounded by and adjoin lands presently owned by said Housing Authority of the City of Little Rock, Arkansas, are no longer necessary for use as streets and alleys by adjoining landowners and the general public for travel by motor vehicle, pedestrian and other traffic, and for means of access to other lands, and are accordingly no longer needed for corporate purposes for the reason that other suitable, safe, adequate and convenient means of access to any areas now or previously served by any portions of the streets and alleys being vacated hereby are presently in existence or are MW being constructed at the present time for use by the public in traveling to and from all such areas; and WHEREAS, in order to better provide for the public welfare, safety, comfort and convenience of the general public, the inhabi- tants of the City of Little Rock, Arkansas, and the users of said streets and alleys, it is necessary to vacate close and abandon the following- described portions of East 40th Street, East 41st Street, Virginia Avenue, Georgia Avenue, and various alleys located in Granite Park Addition to Little Rock, Arkansas, to -wit: All the following portions of streets and alleys located in Granite Park Addition to Little Rock, Pulaski County, Arkansas: East 40th Street and East 41st Street from the east right of way line of U. S. Highway No. 65 to the west right of way line of Alabama Avenue; and Virginia Avenue and Georgia Avenue from the north right of way line of East 41st Street to the south right of way line of East 40th Street; and The alley approximately 20 feet in width extending through Block 44 in a generally north -south direc- tion from East 40th Street to East 41st Street; and The alley approximately 20 feet in width in Block 44 extending in a generally east -west direction from Virginia Avenue to the north -south alley in Block 44; and The alleys approximately 10 feet in width extending through Blocks 42 and 43 in a generally north -south direction from East 40th Street to East 41st Street. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. That it is hereby ascertained and declared that the use, as public streets and alleys, of those portions of East 40th Street, East 41st Street, Virginia Avenue, Georgia Avenue, and certain alleys located in Granite Park Addition to Little Rock, Arkansas, as more particularly hereinbefore and hereinafter described, - 3 - is no longer necessary and needed by adjoining landowners, the general public and for access to other lands in the vicinity; that other streets and routes are presently in existence or are being constructed at the present time which do and will reasonably, safely and adequately serve the needs of those members of the pub- lic traveling to and from areas now or previously served by said portions of the above - mentioned streets and alleys; that said portions of the above - mentioned streets and alleys are no longer required for corporate purposes as public streets and alleys and should accordingly be vacated, abandoned and closed, and all of the right, title and interest of the City of Little Rock, Arkansas in the said vacated portions of said streets and alleys should revert to the adjoining landowner, the Housing Authority of the City of Little Rock, Arkansas. Section 2. That the City of Little Rock, Arkansas under its powers as set forth in Arkansas Statutes (1947) Section 19 -2304, hereby vacates, abandons and closes the following- described streets and alleys and relinquishes, grants and conveys unto the adjoining landowner, the Housing Authority of the City of Little Rock, Arkansas, all of the right, title and interest of the City of Little Rock, Arkansas, of its inhabitants and the public generally, in said streets and alleys, to -wit: - All the following portions of streets and alleys located in Grahite Park Addition to Little Rock, Pulaski County, Arkansas; East 40th Street and East 41st Street from the east right of way line of U. S. Highway No. 65 to the west right of way line of Alabama Avenue; and Virginia Avenue and Georgia Avenue from the north right of way line of East 41st Street to the south right of way line of East 40th Street; and The alley approximately 20 feet in width extending through Block 44 in a generally north -south direc- tion from East 40th Street to East 41st Street; and n - 4 - The alley approximately 20 feet in width in Block 44 extending in a generally east -west direction from Virginia Avenue to the north -south alley in Block 44; and The alleys approximately 10 feet in width extending through Blocks 42 and 43 in a generally north -south direction from Fast 40th Street to East 41st Street. Section 3. That a copy of this Ordinance, duly certified by the City Clerk, shall be filed in the office of the Recorder of Pulaski County, Arkansas, and recorded in the Deed Records of said County.
