ORDINANCE NO. 10 372
AN ORDINANCE AUTHORIZING AND DIRECTING THE MAYOR AND
THE CITY CLERK TO EXECUTE A DEED GRANTING AN EASEMENT
TO THE MISSOURI PACIFIC RAILROAD COMPANY AND THE
WESTERN UNION ON THE LITTLE ROCK RIVERFRONT DRIVE FOR
RAILROAD AND TELEGRAPHING FACILITIES, AND FOR OTHER
PURPOSES.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLE ROCK,
ARKANSAS:
SECTION 1. That the Mayor and the City Clerk are hereby
authorized and directed to execute an easement deed on the
Little Rock Riverfront Drive, granting an easement to the
Missouri Pacific Railroad Company and the Western Union Tele-
graph Company for Railroad and Telegraph facilities. That said
easement deed shall read as follows to -wit:

KNOW ALL MEN BY THESE PRESENTS:
WHEREAS, the City of Little Rock, Arkansas, the Arkansas
State Highway Commission, the United States Bureau of Public Roads,
and the Missouri Pacific Railroad Company, a Missouri Corporation,
the successor to Guy A. Thompson, Trustee, Missouri Pacific Rail-
road Company, Debtor, have heretofore entered into an agreement
for the relocation of certain railroad tracks in connection with
construction of the Riverfront Drive along Water Street in the
City of Little Rock, Arkansas; and
WHEREAS, in connection with said track relocation, it
is necessary and desirable that certain underground conduits con-
taining Western Union and Missouri Pacific cables should remain
in their present locations underneath the right of way for said
Riverfront Drive; and
WHEREAS, the City of Little Rock, Arkansas, acting by
and through its Mayor and City Clerk pursuant to the authority
and directions contained in Ordinance No. duly passed
by the City Council of the City of Little Rock, Arkansas, on the
day of December, 1956, desires to grant an easement to
said Railroad Company for the purpose of enabling it to operate
and maintain underground conduit lines for Western Union and
Railroad facilities on, over, beneath, and across the lands here-
inafter described;

NOW THEREFORE, the City of Little Rock, Arkansas acting
by and through its Mayor and City Clerk, pursuant to the authority
and directions contained in Ordinance No. duly passed by
the City Council of the City of Little Rock, Arkansas, on the
day of December, 1956, approved by the Mayor of the
City of Little Rock, Arkansas, on the day of December, 1956,
for and in consideration of the recitals hereof and of the mutual
benefits to accrue to the parties hereto, does hereby grant, convey,
sell and quitclaim unto the Missouri Pacific Railroad Company, and
the Western Union Telegraph Company, a corporation, and unto their
successors and assigns forever, a perpetual easement for the pur-
pose of the operation, a repair and maintenance of underground
cable conduits and appurtenant manholes on, over, beneath, and
across the following lands situated in the City of Little Rock,
County of Pulaski, State of Arkansas, to wit:
A strip of land ten feet in width, being five feet
on either side of three straight lines running between four man-
holes now in place, the location of said manholes being described
as follows:
1. Begin at the intersection of the east line of
Ashley Street and south line of Water St., thence
northerly along the northerly extension of the
east line of Ashley St. a distance of 92.4 ft.,
thence on a deflection angle of 900 00' to the left
a distance of 216.0 feet to the manhole.
2. Begin at the intersection of the east line of
Ashley St. and the south line of Water Street,
thence eastwardly along the south line of Water
Street a distance of 116.1 feet thence on a de-
flection angle of 900 00' to the left a distance
of 13.1 feet to the manhole.
3. Begin at the intersection of the west line of
Main Street and the south line of Water Street
thence eastwardly along the south line of Water
Street a distance of 10.5 ft., thence on a deflection
angle of 900 001 to the left a distance of 23.5 ft.
to the manhole.
4. Begin at the intersection of the west line of
Main Street and the south line of Water St., thence
eastwardly along the south line of Water St., a
distance of 92.3 ft., thence on a deflection angle
of 900 001 to the left a distance of 23.4 feet to
the manhole.
TO HAVE AND TO HOLD the same unto the said Missouri
Pacific Railroad Company, a corporation and The Western Union
Telegraph Company, a corporation, their successors and assigns
forever, with all appurtenances thereto belonging.
Before occupying any one or more of the expressway
lanes of said Riverfront Drive for the purpose of carrying out
repair or maintenance operations pertaining to the rights herein
granted, said Railroad Company or Telegraph Company, their success-
ors or assigns, shall give adequate notice to the traffic control
authorities of the City of Little Rock, Arkansas; and shall, while
so engaged in carrying out such repair or maintenance operations,
erect and maintain adequate traffic barricades and warning devices.

SECTION 2. That all ordinances and parts of ordinances in
conflict herewith are hereby repealed and this ordinance shall
be in full force and effect immediately upon its passage and
approval.
