AN ORDINANCE VACATING AND ABANDONING THE FOLLOWING
PORTION OF KAVANAUGH STREET: A STRIP OF LAND TWENTY -FIVE
FEET IN WIDTH FROM THE ;NEST LINE, EXTENDED SOUTH, OF LOT
ONE, WESTOVER HILLS SUBDIVISION, PULASKI COUNTY, ARKANSAS,
TO A POINT 5.72.8 FEET DUE EAST OF SAID WEST LINE, EXTENDED
SOUTH, OF SAID LOT ONE, WHICH STRIP OF LAND WAS DEDICATED
AS A STREET IN THE PLAT OF WESTOVER HILLS SUBDIVISION,
PULASKI COUNTY, ARKANSAS, NOW APPEARING IN PLAT BOOK 4,
PAGE 89, IN THE PULASKI COUNTY RECORDER'S OFFICE; AND FOR
OTHER PURPOSES.
WHEREAS, a petition was duly filed with the City Council of
the City of Little mock, Arkansas, on the 19th day of November,
1956, asking the City Council to vacate and abandon:
and
A strip of land 25 feet in width from the west
line, extended south, of Lot 1, Westover Hills
Subdivision, Pulaski County, Arkansas, to a
point 572.8 feet due east of said west line,
extended south, of said Lot 1, which strip of
land was dedicated as a street in the plat of
Westover Hills Subdivision, Pulaski County,
Arkansas, now appearing in Plat Book 4, page 89,
in the Pulaski County Recorder's Office;
WHEREAS, after due notice as required by law, the Council has,
at the time and place mentioned in the notice, heard all persons
desiring to be heard on the question, and has ascertained that the
portion of the street hereinbefore described has heretofore been
dedicated to the public use as a street; has not been actually used
by the public generally for a period cf at least five years subsequent
to the filing of the plat dedicating said street; that all owners of
the props rty abutting upon the portion of the street to be vacated
have filed with the Council their written consent to such abandonment;
and that the public interest and welfare will not be adversely affected
by the abandonment of the portion of the street hereinbefore described;
NOW, THEREFORE, be it ordained by the City Council of the City
of Little Rock, Arkansas:
SECTION 1. The City of Little Rock, Arkansas, hereby releases,

vacates and abandons all its rights, together with the rights of
the public generally, with the exception of the easement set out
in Section 2 hereof, in and to that portion of the street designated
as follows:
A strip of land 25 feet in width from the west
line., extended south, of Lot 1, Westover Hills
Subdivision, Pulaski County, Arkansas, to a
point 572.8 feet due east of said west line,
extended south, of said Lot 1, which strip of
land was dedicated as a street in the plat of
Westover Hills Subdivision, Pulaski County,
Arkansas, now appearing in Plat :Book 4, page 89,
in the Pulaski County Recorder's Office.
Section 2. An easement for the use and benefit of the Little
Rock Municipal Water Works is retained. Said easement being an
eight foot strip, the center line of which lies along the two inch
pipe line as it now exists and the existing service lines, for the
purpose of providing ingress and egress to permit installation,
maintenance, repair or replacement of water pipe lines, whether
one or more, and no structures may be placed upon said easement.
Section 3. A copy of this ordinance, duly certified by the
City Clerk, shall be filed in the Office of the Recorder for
Pulaski County, Arkansas, and recorded in the Deed Records of
this County.
Section 4. This ordinance shall take effect and be in force
from and after its passage.
