10444ORDINANCE NO. 10,444 AN ORDINANCE REGULATING THE TYPE OF CONSTRUCTION OF DRESSING PLANTS, THE METHODS OF SLAUGHTERING THERE -IN, DISPOSAL OF THE OFFAL, THE HEALTH OF THE PEE.SO, AND PROVIDING A PENALTY FOR VIOLATION THEREOF, AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF LITTLV ROCK, ARKANSAS: SECTION 1. That the construction, operation and personnel of fish dressing plants offering for consumption fish for sale in the City of Little Rock, Arkansas, shall be regulated and that for the purpose of such regulation the following terms are set forth and defined: a. Fish Plants: Any place or building, and structure in connection therewith, where fish is killed, handled, or processed for food intended for sale to the public. b. Proprietor: Any person, firm, corporation, or governmental agency operating a fish dressing plant. c. Personnel: Any person employed in a fish dressing plant who does or may in any manner come in contact with dressed fish. SECTION 2. That all fish dressing plants must be in compliance with these regulations. a. The proprietor shall be responsible for the compliance with these regulations. b. Any fish dressing plant located outside the corporate limits of the City of Little Rock, and selling or differing for sale dressed fish within the City of Little Rock, shall submit a letter from the City, County or State Health Department to the City Health Officer stating that said plant does meet the requirements set forth in this ordinance. That no part of this paragraph shall pertain to any fish dressing plant maintains a Federal inspector. SECTION: 3. Permits. It shall be unlawful for any person to operate a fish dressing plant in the City of Little Rock who does not p, *s"s. an unrevoked permit from the Health Officer. Such permit ]: be posted in a conspicuous place. Only persons who comply with the requirements of this ordinance shall be entitled to receive and retain such a permit. Such a permit may be temporarily suspended by the health officer upon the violation by the holder of any of the terms of this ordinance, or revoked �r -2- after an opportunity for a hearing by the City Board of 'Health. SECTION 4. Unlawful to sell: It shall be unlawful for any eating establishment or food stores to serve or sell fish in the City of Little Rock that has been obtained from other than approved sources. SECTION 5. That buildings and structures shall be constructed as f ollows : a. Construction: Buildings and structures shall be solidly constructed and maintained in good repair. They shall be constructed and maintained in a rat -proof condition. b. Floors: Floors of fish dressing plants must be tights sound, easily cleanable, kept clean, and constructed of concrete or other Material that is impervious to moisture. They shall be maintained in good repair and properly sloped to trapped floor drains. Floors shall be cleaned by flushing as often as necessary and at least at the end of the day's operation. c. Walls and Ceilings: Walls and pillars of fish dressing plants must be constructed of concrete or other material that is impervious to moisture. The ceilings, walls.* doors, and pillars shall be painted a light color, or finished in an approved manner, kept clean and in good repair. The walls and ceilings shall be cleaned by flushing as Bften as necessary and at least at the end of the day's operation. d. Lighting and Ventilation: Fish dressing plants shall be adequately lighted and properly ventilated. e. Screening and Vermin Control: All openings to the outer air must be properly screened with at least 16 mesh wire or otherwise protected against the entrance of flies and other vermin. All necessary vermin - control measures must be taken. f. Toilet Facilities: Adequate and conveniently located toilet facili- ties must be provided. They must be kept clean, adequately lighted properly ventilated., and in good repair. The door must be self- closing and the room must be completely sealed in such a manner as to prevent the entry of flies, rats, or other vermin. Screening alone will not be considered adequate seal- 'ing of any inner opening to a toilet room. Where a sanitary sewer is accessible, connection must be made thereto; otherwise, the disposal of human wastes must be in accordance with the requirements set forth in the City ordinances. IW -3- g. Lavatory Facilities: Adequate and convenient hand - washing facilities must be provided. Such facilities shall include hot and cold water under pressure, soap, and approved sanitary towels. The use of the common towel is prohibited. Lavatories must be kept clean and in good repair. SECTION b. That all plants shall have hot and cold running water under pressure as follows: A safe and adequate supply of hot and cold running water under pressure must be provided in all fish dressing plants. Where a public water system is available, an connection must be made thereto; otherwise, the water shall be obtained from a supply meeting the requirements set forth under the Rules and Regulations of the Arkansas State Board of Health pertaining to "Semi - Public Water Sup;lies.n SECTION 7. That waste matter hereinafter defined must be disposed of as follows: a. Liquid,Wastes: Proper facilities must be provided for the collection and disposal of all liquid wastes, including blood, floor washings, and other material* These wastes shall not be discharged on the surface of the ground nor into 'a flowing stream or body of water that may endanger a public or private water supply or be detrimental to public health. b. Solid Wastes: Offal, fat, refuse, and waste material must be placed , .., in covered metal containers and disposed of in a sanitary manner immediately after the day's operation. All garbage receptacles shall be washed when emptied and treated with a disipfectant. The feeding of uncooked offal, scraps, and flesh to any animal is prohibited. SECTION 8. That diseased fish and those dying other than by being slaughtered are regulated as follows: a. Diseased Fish: No fish known or suspected to be affected with any disease shall be killed and sold or offered for sale. The burden of discover- ing and eliminating from production for food all carcasses of infected fish is hereby placed upon the proprietor. SECTION 9.• That equipment and utensils used shall be defined and provided for as follows: a. Construction: All containers, utensils and other equipment used in preparing, processing, or handling fish must be constructed so as to be easily cleanable and no utensil shall be used that will chip or rust. b. Cleaning Facilities: Adequate facilities must be provided fQr the proper cleaning of all utensils, containers, and equipment used in processing, storing, or sale of the fish. Such facilities shall include a two - compartment vat equipped with running hot and cold water under pressure. C* Cleaning: All containers, utensils, or other equipment used in pro - oessing. storing, or sale of the fish must, after each day's use or run, be thoroughly cleansed with the aid of a suitable detergent or soap and later rinsed or immersed in clean hot water or sterilized with live steam, then allowed to drain and air dry. d. Tables, Racks, Etc.: All tables and racks shall be smooth, free of cracks, easily cleanable and kept clean. The eviscerating table shall be constructed of metal or other material that is impervious to moisture. It shall be sloped so as to drain and shall be constantly flushed with water when in use. FC I Killing And Skinning Room: The killing and skinning of Fish shall be carried on in a room separate and apart from any room in -h ich live fish is kept, or where eviscerating is done, or the dressed carcass is being handled or stored. After the removal of skin, all fish sYia7.1 be so handled as to prevent contamination. E TION That a killing and skinning room, separate and apart from any room in which live fish is kept or where killing and skinning of fish is carried on, shall be provided as an eviscerating room. This room shall be used for no other purpose. ION ' 2. That chilling and storing of fish shall be as follows: Dressed fish must be immediately chilled in an approved manner. Storage shall be accomplished in a sanitary manner in an adequately refrigerated place. S p That packing and transportation of fish shall be as follows:- cing fish shall be of new, single service mat All containers used for pla or nonabsorbent containers that are thoroughly cleaned and sterilized before being used. During transportation, dressed fish shall be delivered in clean closed vehicles or otherwise protected from dust and other contamination. ?7 c: y r X_ ION 14- That fish live or dressed can only be sold by wholesale or retail establishments approved by the City Health Officer. SECTION 15. That the following provisions are made for the health of personnel employed: a. Ny person affected with any disease in a communicable stage shall be employed in a fish dressing plant. If there is any reason to suspect that any of the personnel may have a disease in a communicable stage, the.person or persons suspected may be required to obtain a certificate of physical examina- tion by a physician, legally licensed to practice medicine in Arkansas, to etermine the presence of any disease in a communicable stage. r all b. ION I That the penalty for violation of any provisions of this Cordinance is as follows: Any person convicted of violating any of the provisions of this ordinance shall be fined any sum not to exceed one hundred (1100.00) and each day of such violation shall constitute a s'': epsrate oltfense. IO p10 That all ordinances and parts of ordinances in conflict herewith are hereby repealed, and as the public health, peace and safety of the community are directly affected by the provisions of this ordinance, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after its passage.
