AN ORDINANCE ANNEXING A CERTAIN PORTION OF THE CITY OF
LITTLE ROCK, ARKANSAS, TO WATER IMPROVEMENT DISTRICT
NO. 78 OF LITTLE ROCK, ARKANSAS
WHEREAS, parties claiming to be the owners of a majority or
more in assessed value of the real property located within the
territory hereinafter described, which is contiguous to Water
Improvement District No. 78 of Little Rock, Arkansas, a duly created
and existing improvement district, have filed a petition praying
that said territory be annexed to said District for the purposes
hereinafter set out; and
WHEREAS, after due notice as required by law, the City Council
of the City of Little Rock, Arkansas, has heard all parties desiring
to be heard, and has ascertained that said petition was signed by
more than a majority in assessed value of the owners of real property
within said territory; now, therefore,
BE IT ORDAINED by the City Council of the City of Little Rock,
Arkan$ as:
SECTION 1. That the following described property in the City
of Little Rock, County of Pulaski, State of Arkansas, to -wit:
South Half (SQ) Northwest Quarter (NW4) Southwest
Quarter (SW I-) and East Half (E -) South Half (S'J)
North Half (NJ), Northwest (NWT} Southwest (SW),
All of Success Addition to the City of Little Rock, Arkansas
EXCEPT
Lots 4 to 9, inclusive of Block 15,
Lots 1 to 9, inclusive of Block 16,
All of Block 17, 18, and 24
Lots 1 to 6, inclusive, and Lots 10, 11,
and 12, Block 23,
Lots 3 and 4, Block 1,
Lots 1 and 2, Block 8,
Lots 11 and 12, Block 25,
All in Section 36, Township 2 North, Range 13 West; all in
the City of Little Rock, County of Pulaski, State of Arkansas;
be and the same is hereby added to and annexed to Water Improvement
District No. 78 of Little Rock, Arkansas, and the Commissioners of
said District shall proceed to make the improvements petitioned for
by laying water mains to supply the inhabitants of said territory
with water, and to construct water mains to a source outside the

boundaries of the district, and the Commissioners may enter into a
contract or contracts for a water supply, or may purchase water to
be redistributed to the consumers on the water mains built by the
district, as they may deem best, such water mains to be constructed
in such a manner and with such materials and to be located in such
places as the Commissioners may deem for the. best interest of the
property holders, and that the cost thereof, over and above any aid
received from any agency of the federal or city government, be
assessed and charged upon the above described property; provided, the
liability of each lot or tract of land shall be limited to its
assessed benefits.
SECTION 2. That said annexed territory shall be known as
Annex No. 1 to Water Improvement District No. 78 of Little Rock,
Arkansas.
SECTION 3. That the Commissioners of Water Improvement
District No. 78 of Little Rock, Arkansas, shall make the assessment
of benefits for said improvements on the lots, blocks or parcels of
real property in the territory herein annexed on the same basis as
if said territory were included in the original District, and shall
file said assessments with the City Clerk.
SECTION 4. That this ordinance shall take effect and be in
force from and after its passage.
