10799r • f ORDINANCE NO. 10,799 AN ORDINANCE PROVIDING FOR THE RE- ESTABLISHMENT OF THE LITTLE ROCK PLANNING COMMISSION UNDER THE PROVISIONS.OF ACT.186 OF-THE ACTS OF 1957; PRESCRIBING THE POWERS AND DUTIES OF SAID COMMISSION; REPEALING CERTAIN OTHER ORDI- N,A.NCES; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRXCTORS OF THE CITY OF LITTLE ROCK, N ARKANSAS: m r, Ln SECTION 1. Purpose. In order to secure the benefits to the public of a co- ordinated, adjusted and harmonious development of M `" the City of Little Rock and its environs and to promote the health, safety, morals, order, convenience, prosperity, and general welfare r' of the citizens thereof, and pursuant to the provisions of Act 186 M of the Acts of 1957, there is hereby created a commission which • shall be known and styled,as the Little Rock Planning Commission. o SECTION 2. Members. The Little Rock Planning Commission 'A shall consist of a total of ten (10) members, of which number nine ro ra (9) members shall be citizens appointed by the Mayor /City Manager and approved by the Board of Directors of the City of Little Rock, one (1) member shall be a member of the Little Rock School Board or its appointed representative who shall be selected by said Board and approved by the Board of Directors of the City of Little Rock. The citizen members shall be qualified by knowledge and experi- ence in matters pertaining to the physical, social, economic and cultural development of the City, shall hold no other appointive or elective public office in the City government except membership in i the Little Rock Board of Adjustment or the Metropolitan Area Planning Commission of Pulaski County and shall be residents of the City of Little Rock. All members shall serve without compensation. SECTION 3. Terms of Office. Each appointed member shall serve for a term of three (3) years, provided however, that present members now serving shall continue serving their present terms. The anniversary date of each term shall be the first day of November, except that appointments to fill vacancies shall be for unexpired OGG-�,t terms only, and except that any member whose term expires shall continue to serve until his successor is appointed and qualified. SECTION 4. Administrative Powers and Duties. At the first regular meeting in January of each year, the Commission shall elect a Chairman and Vice- Chairman. The Commission-shall adopt rules and regulations to govern its proceedings and provide for a regular meeting date, at least once each month; create such com- mittees as may be necessary to the proper exercise of its functions and prescribe the duties therefor. Special meetings may be called from time to time. According to the rules of the Commission five (5) members shall constitute a quorum. The Commission shall make recommendations and an annual report to the Mayor and Board of Directors of the City of Kittle Rock con- cerning the operation of the Commission and the status of planning within its jurisdiction. The Commission shall prepare and submit an annual budget in the same manner as regular departments of the city government. If deemed advisable, the Commission may establish an advisory committee or committees. SECTION 5. Staff. In the conduct of its work, the Commission shall utilize the services of the Planning Administrator and the planning staff authorized by ordinance. The employment of personnel shall be in conformity with the Civil Service rules and regulations. The Planning Administrator shall serve as Secretary of the Com- mission; he shall maintain in his office all documents and records of the Commission, including a record of the minutes of meetings, the current membership, the organization, and the rules and regu- lations of the Commission; and he shall direct and supervise the planning staff. SECTION 6. Planning Powers and Duties. The Commission is vested with the powers and charged with the duties prescribed in Act 186 of the Acts of 1957• s SECTION 7. Repeal. Ordinance No. 9669, 10,020, and 10,263, and all other ordinances in conflict herewith, are hereby repealed. All rights vested and all actions taken under previous ordinances are not affected hereby. SECTION 8. Severability. If any section, clause, paragraph, -__ -Y provision or portion of this ordinance shall be held invalid or F unconstitutional such holding shall not affect any other section, clause, paragraph, provision or portion hereof.
