BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS:
SECTION 1, Section 59 Subsection B, Paragraph 1 c of
Ordinance No. 109,808 is hereby emended to read as follows:
"c, EXCAVATION AND FILLS: Excavation shall coin
gist of all cutting in the roadway and ad-
jacent areas, and the cutting and removal
of all unsuitable material, reprdless of
character, from the subgrade, all in conformity
with the limes and grade shown on the plans.
Unless directed by the engineer, excavation
shall not be carried below the elevations in-
dicated on the drawings except when soft or,
otherwise unsuitable material is encountered.
This material shall be rem ved and replaced
with suitable material in accordance with the
proce4we specified for fills, with the further
provision that all loose rock or boulders found
in the subgrade sherd be broken off and removed
to a depth of not xlose than six inches (6 ")
below t`he stitface of the subgrade. Suitable
material shall consist of earth, sand, gravel,
or other satisfactory.materials.
Fills shall be built up with suitable mater
ials ,from ex- vat:;ov which is free from stleb, a�

trees, tree boles, rubbish, and frozen materials.
Earth or friable materials used in constructing
fills shall be placed in successive horizontal
layers of, loose material not. more than .eight
inches (8 "),in depth. Each layer shall be spread
unifoxmly and shall be wetted and rolled with a
sheepefoot roller, pneumatic tired roller, or
other approved equipment, until thoroughly com-
pacted to ninety per cent (90%) of maximum density
obtained at optimum moisture content, as deter-
mined by the Modified Proctor Compaction Test.
Where rock is to be incorporated in fills
composed largely of earth or friable materials,
the rock shall be reduced to a maximum size of
six inches (611) with the further provision that
no rock of six inch (61') maximum size be within
six inches (6 ") of the finished subgrade. Sub -
grade compaction shall-extend a minimum distance
of one foot (11) beyond the outside edges of the
pavement and/or curb and gutter, and a maximum
distance as determined by the width of right -of-
way. Except as otherwise provided, the top six
inches (6'-) of subgrade in eveEZ area shall be
compacted to ninety -five per cent (95%) of max-
imum density obtained at optimum moisture content,
as determined by the Modified Proctor Compaction
Test, The Engineer shall notify the City Engi-
neer at least twelve (12) hours prior to placing
any material on the completed subgrade in order
that the City Engineer may check the line, grade,
and crown of the subgrade. If the City Engineer
does not make the inspection after proper noti=

fication within the said twelvw,(12) hour period
the subgrade shall be' deemed approved#
in those instances where more than one in-
spection by the City Engineer is necessary due
to what is determined by the first inspection
to be unsatisfactory construction an inspection
fee in the amount of Twenty -five Dollars ($25.00)
shall be assessed against the contractor for each
such additional inspection. Provided, however,
where there is evidence that such unsatisfactory
construction resulted by reason of an act of God
or through no fault of the contractor or owner
then no such inspection fee shall be assessed re-
gardless of the number of inspections necessary.
Upon completion of all excavation and fill
within the right -of -way, the City Engineer may
require additional Proctor Density Tests at any
given location to determine the compaction of the
subgrade. The costs of all tests shall be borne
by the contractor."
SECTION 2. It has been determined that the lack of stan-
dards and specifications for streets, storm sewers and other im-
proyonents within the area of jurisdiction of the City of Little
Rock including improvement districts, covering design, approvals,
materials, construction methods, construction materials, and
maintenance of streets creates a condition hazardous to the
public peace, health and safety of the citizenry of this City;
that this ordinance will correct the evil; therefore, an emer-
gency is hereby declared to exist and this ordinance being
necessary fcfr the public peace, health and safety, shall be
in full force and effect from and after its passage and approval

and all ordiAinces and parts of ordinances in conflict herewith
are hereby repealed.
