That the zoning classification of the following described property be changed from C -3, General Commercial District, to PCD, Planned Commercial District: Tract 63 and the South 230 feet of Tract 50, West Highland Subdivision, and part of the East half of Mason Street, now closed by City Ordinance 17289, in the City of Little Rock, and in the Southeast Quarter of the Southeast Quarter of Section 4, Township I North, Range 13 West, Pulaski County, Arkansas; more particularly described as: Starting at the Northeast corner of said Tract 50, West Highland Subdivision; thence SO1 °25'50 "W along the East line of said Tract 50 for 90.0 feet to a rebar with cap at the point of beginning; thence continuing SO 1°25'50 "W along the East line of Tract 63, West Highland Subdivision for 548.17 feet to a point of the North right -of -way line of Kanis Road; thence N87 °03'51 "W along the said right -of -way line for 59.87 feet to the beginning of a non - tangential curve to the right having a radius of 364.43 feet; thence along said right -of -way line for 190.38 feet to the centerline of Mason Street, now closed by City Ordinance Number 17289; thence NO1 °40'27 "E along the said centerline for 420.57 feet to a cotton picker spindle; containing 162,384 square -feet, (3.728 acres), more or less. Section 2. That the approval of Hilton Garden Inn Short -Form PCD (Z- 8364 -C), located at 10914 Kanis Road, is subject to compliance with the following additional conditions: • That the preliminary site development plan/plat be approved as submitted, including _ �o all staff comments and conditions as outlined in the Planning Commission Agead Staff Report in paragraphs D, E, F and including any conditions indicated in the sbtt. Section 3. That the preliminary site development plan /plat be approved as recommended by the Little Rock Planning Commission. Section 4. That the change in zoning classification contemplated for Hilton Garden Inn Short -Form PCD (Z- 8364 -C), located at 10914 Kanis Road, is conditioned upon obtaining a final plan approval within the time specified by Chapter 36, Article VII, Section 36 -454 (e) of the Code of Ordinances. Section 5. That the map referred to in Chapter 36 of the Code of Ordinances of the City of Little Rock, Arkansas, and designated district map be and is hereby amended to the extent and in the respects necessary to affect and designate the change provided for in Section 1 hereof. Section 6. That this ordinance shall not take effect and be in full force until the final approval of the plan. Section 7. Severability. In the event any title, section, paragraph, item, sentence, clause, phrase, or word of this ordinance is declared or adjudged to be invalid or unconstitutional, such declaration or adjudication shall not affect the remaining portions of the ordinance which shall remain in full force and effect as if the portion so declared or adjudged invalid or unconstitutional were not originally a part of the ordinance. Section 8. Repealer. All laws, ordinances, resolutions, or parts of the same that are inconsistent with the provisions of this ordinance are hereby repealed to the extent of such inconsistency.
