ORDINANCE NO. 10,902
ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY OF
LITTLE ROCK, ARKANSAS, VACATING AND CLOSING THE
ALLEY IN BLOCK 1, FITZGERALD'S ADDITION TO THE
CITY OF LITTLE ROCK, ARKANSAS.
WHEREAS, a petition was duly filed with the Board of
Directors of the City of Little Rock, Arkansas, on the 13th day of
January, 1959, asking the Board of Directors to vacate and abandon
all of the alley in Block 1,'Fitzgerald's Addition to the City of
Little Rock, as designated on the plat of said Addition now appear-
ing of record in Deed Book AB, Page 263, in the office of the Recorder
of Pulaski County, Arkansas, subject, however, to the existing ease-
ment'in said alley in favor of the City of Little Rock for the use
and benefit of the Little Rock Sanitary Sewer System; and
WHEREAS, after due notices as required by law, the Board
of Directors has, at the time and place mentioned in the notice,
heard all persons desiring to be heard on the question and has ascer-
tained that the alley, hereinbefore described, has heretofore been
dedicated to the public use as an alley, as herein described; has not
been actually used by the public generally for a period of at least
five (5) years subsequent to the filing of the plat; that all of the
owners of the property abutting upon the alley to be vacated have
filed with the Board of Directors their written consent to such
abandonment; and that public interest and welfare will not be
adversely affected by the abandonment of such alley;
NOW, THEREFORE, BE IT ORDAINED by the Board of Directors of
the City of Little Rock, Arkansas:
SECTION 1. The City of Little Rock, Arkansas, hereby re-
leases, vacates and abandons all its rights, together with the rights
of the public generally, in and to the alley designated as follows:
The alley running North and South through the middle
of Block 1, Fitzgerald's Addition to the City of
Little Rock, Arkansas, as designated on the plat of
said Addition, now appearing of record in Deed Book
AB, Page 263, in the office of the Recorder of Pulaski
County, Arkansas;
subject, however, to the existing easement in favor of the City of

Little Rock for the use and benefit of the Little Rock Sanitary
Sewer System and subject to the right of Southwestern Bell Telephone
Company, Arkansas Power & Light Company, and Arkansas Louisiana
Gas Company, respectively, to maintain and service their utility
facilities presently located in said alley.
SECTION 2. A copy of this Ordinance, duly certified by
the City Clerk, shall be filed in the office of the Recorder of
Pulaski County and recorded in the Deed Records of the county.
SECTION 3. This Ordinance shall take effect and be in
force from and after its passage.
