ORDINANCE NO. 10,905
AN ORDINANCE REGULATING THE OPERATION OF MOBILE CANTEEN
UNITS IN THE CITY OF LITTLE ROCK; REQUIRING A PERMIT
THEREFOR; DEFINING CERTAIN TERMS IN CONNECTION THEREWITH;
PROHIBITING THE SALE OF UNWHOLESOME OR CONTAMINATED FOOD
OR DRINK THEREFROM; PROVIDING FOR INSPECTION THEREOF;
FIXING A PENALTY FOR THE VIOLATION OF THIS ORDINANCE;
AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
ROCK, ARKANSAS:
SECTION 1. The following Definitions shall apply in the
interpretation and the enforcement of this ordinance:
A. A mobile canteen unit is a vehicle offering for sale
prewrapped and sealed food products and dispensing
coffee.
B. Employee, The term employee shall mean any person who
may be owner or operator of a mobile canteen unit.
C. Utensils shall include any kitchenware, glassware,
cutlery, or utensils that come in contact with food
or drink during storage, preparation, or serving of
foods.
D. Public Health Director. The term "Public Health Director"
shall mean the Public Health Director of the City of
Little Rock or his authorized representative.
E. Person. The word "person" shall mean person, firm,
corporation or association.
SECTION 2. Permits. It shall be unlawful for any person to
operate a mobile canteen unit in the City of Little Rock who does
not hold an unrevoked permit from the Public Health Director. Such
permit shall be posted in a conspicuous place in said mobile canteen
unit. Only persons who comply with the requirements of this ordi-
nance shall be entitled to receive and retain such a permit.
Any permit issued pursuant to this ordinance may be suspended
or revoked by the Public Health Director for the violation of any
provision of this ordinance. Provided, however, that no permit
shall be permanently revoked until after a hearing to be conducted
by the Public Health Director.
SECTION 3. Examination and Condemnations of Unwholesome or
Adulterated Food or Drink.
Samples of food, drink or other sub-
stances may be taken and examined by the Public Health Director

as often as may be necessary for the detection of unwholesomeness
or adulteration. The Public Health,Director may condemn and for-
bid the sale of, or cause to be removed or destroyed, any food or
drink which is unwholesome or adulterated.
SECTION 4. The Inspection of Mobile Canteen Units. At least
once every six months and more often if he deems necessary the
Public Health Director shall inspect every mobile canteen unit
operating within the City of Little Rock. In case the Public
Health Director discovers a violation of any item of sanitation
he shall make a second.inspection after the lapse of such time
as he deems necessary for the condition to be remedied and the
second inspection shall be used in determining compliance with the
requirements of this ordinance. Any violation of this ordinance
on the second inspection shall call for immediate suspension of
the permit. One copy of this inspection report shall be left by
the Public Health Director with the mobile canteen unit operator.
Another copy of the inspection report shall be filed with the
records of the Health Department. At the time of each inspection
the inspector shall write a detailed explanation on the back'of
the report. The persons operating the mobile canteen unit shall
furnish the Public Health Director each month a daily route sche-
dule of the locations he is serving and the approximate time of
arrival at each location.
SECTION 5. The Owner or Operator of a Mobile Canteen Unit or
Units must secure his food products from sources approved by the
Public Health Director, which sources must in every way comply with
Ordinance No. 7331. If the location of said sources is outside the
corporate limits of the City of Little Rock, the Little Rock Health
Department will make a joint inspection with the health unit in that
locality which has jurisdiction, to determine if said sources meet
the requirements of Ordinance No. 7331 of the City of Little Rock.
When inspection is made outside the corporate limits of the City of

Little Rock the owner of the mobile canteen unit using the source
inspected will pay the reasonable travel expense of the Public
Health Director or his authorized representative incurred in
making such inspection.
SECTION 6. There shall be no preparation of food or drink
whatever in mobile canteen units.
SECTION 7. All equipment on the Mobile Canteen Unit used
for storing, transporting and serving of any food or drink what-
ever shall comply with all applicable standards for food and
drink serving equipment with regard to sanitary design, construction,
and installation, as approved by the Public Health Director, and
in full accordance with the applicable provisions of Ordinance No.
7331, and with the following additional requirements:
A. Coffee urns shall be readily removable of all parts
thereof shall be readily accessible for cleaning.
B. The bag or device which contains used coffee grounds
shall not be cleaned except at said approved source as de-
fined in Section 5 hereof. Suitable facilities shall be pro-
vided on the mobile canteen unit for the storing of such bags
or devices and the grounds therein. Such bags or devices
shall be properly cleaned at said approved source before
being reused for coffee making.
C. Faucets and guage glasses shall be so designed as to
be readily accessible or removable for inspection and cleaning.
D. All waste products shall be disposed of so as not to
create any nuisance upon public or private property. The owner
or operator of any mobile canteen unit shall provide suitable
containers, approved by the Public Health Director, for the
disposal of all waste - products, including used paper cups and
containers.
E. The entire operation and all equipment used on mobile
canteen units shall be maintained in a clean and sanitary manner

at all times
.SECTION 8. Wholesomeness of Food and Drink. All food and
drink shall be clean, wholesome, free from spoilage, and so pre-
pared as to be safe for human consumption. All milk, fluid milk
products, ice cream, and other frozen desserts offered for sale
shall be from approved sources and prewrapped and sealed. Cream
shall be refrigerated and kept in covered, single- service con-
tainers. Sugar shall be served in individually sealed, single-
service packages.
SECTION 9. Six months after the passage of this ordinance
all mobile canteen units which dispense readily perishable foods
shall be equipped with adequate mechanical refrigeration apparatus.
SECTION 10. No mobile canteen unit shall under any cir-
cumstances dispense any food or drink when parked within the
right -of -way of any public street in the City of Little Rock.
Provided, further, that no mobile canteen unit shall dispense
any food or drink when parked on any other public property
without first obtaining written authority therefor from the
City Manager or his duly authorized representative.
SECTION 11. Penalties. Any person who violates any provision
of this ordinance shall be deemed guilty of a misdemeanor, and
upon conviction thereof shall be fined not less than $25.00 nor
more than $200.00. Each and every day a violation of the pro-
visions of this ordinance exists shall constitute a separate of-
fence.
SECTION 12. Separability Clause. Should any section, para-
graph, sentence, clause, or phrase of this ordinance be declared
unconstitutional or invalid for any reason, the remainder of said
ordinance shall not be affected thereby.
SECTION 13. All ordinances and parts of ordinances in con-
flict herewith are hereby repealed and this ordinance shall be in
