ORDINANCE No. 10,913
AN ORDINANCE VACATING, ABANDONING AND CLOSING A
PORTION OF ONETA STREET IN THE CITY OF LITTLE
ROCK, ARKANSAS; AND FOR OTHER PURPOSES
Whereas, a petition was duly filed with the Board of
Directors of the City of Little Rock, Arkansas, on the 25th
day of February, 1959, asking the Board of Directors to close
and vacate Oneta Street between Blocks 2 and 3, McIntosh
No. 2, Addition to the City of Little Rock, Arkansas, as
designated on the plat of said addition, now appearing of record ,
-Plat Book No. 1, at page 253, in the—office of the° -Rec
of Pulaski County, Arkansas.
Whereas, after due notice as required by law, the Board
of Directors has, at the time and place mentioned in the notices
heard all persons desiring to be heard on the question and has
ascertained that the street hereinbefore described, has here.
tofore been dedicated to the public; has not been actually
used by the public generally for a period of at least five
yeers subsequent to the filing of the plat; that all the
owners of the property abutting upon said street to be vacated
have joined their written consent to such closing by joining
in and signing the petition; and that public interest and
welfare will not be adversely affected by the abandoning and
closing of such street.
NOW THEREFORE, BE IT ORDAINED BY THE, BOARD CF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock, Arkansas, hereby
releases, vacates and abandons all its rights, together with
the rights of the public generally, excepting however, any
utility easements now in effect, and the right of the City to-
use said street for drainage purposes, if necessary, in and to
the street designated as follows:
The dedicated street known as Onetta Street between
Blocks 2 and 3, McIntosh No. 20 Addition to the City
of Little Rock, Arkansas, as shown by the Plat and
Bill of Assurance on file in Plat Book No. 1, at page
253, in the office of the Recorder of Pulaski County,
Arkansas.
SECTION 2. A copy of this ordinance duly certified by
the City Clerk shall be filed in the Office of the Recorder of
Pulaski County, Arkansas, and recorded in the deed records of
said county.
SECTION 3. This ordinance shall take effect and be in
force and effect from and after its passage and approval.
