AN ORDINANCE ACCEPTING THE LOW BID OF BEN M. HOGAN COMPANY
FOR THE WIDENING AND PAVING OF WEST EIGHTH STREET BETWEEN
LOUISIANA AND CENTER STREETS IN THE CITY OF LITTLE ROCK;
AUTHORIZING AND DIRECTING THE MAYOR AND CITY CLERK TO EXECUTE
A CONTRACT WITH SAID COMPANY IN KEEPING WITH STANDARDS AND
SPECIFICATIONS AS SET FORTH IN ORDINANCE NO. 103572; APPROPRIA-
TING THE SUM OF FOUR THOUSAND TWO HUNDRED TWENTY SEVEN AND 55/100
DOLLARS ($4,227.55) THEREFOR; AUTHORIZING AND DIRECTING THE
CITY MANAGER AND DIRECTOR OF FINANCE TO EXECUTE THE NECESSARY
WARRANTS IN PAYMENT THEREFOR; DECLARING AN EMERGENCY; AND FOR
OTHER PURPOSES.
WHEREAS, the City by proper legal advertisement requested bids
for the widening and paving of West Eighth Street between Louisiana
and Center Streets within the City of Little Rock, and
WHEREAS, the bid of Ben M. Hogan Company of Little Rock, 'Irkansas,
of Four Thousand Two Hundred Twenty Seven and 55/100 Dollars ($4,227.55)
is the lowest bid submitted therefor, and
WHEREAS, the City is desirous of awarding a contract for said
widening and paving to said Ben M. Hogan Company,
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS:
SECTION 1. A contract for the widening and paving of West
Eighth Street between Louisiana and Center Streets at a cost to the
City of Little Rock of Four Thousand Two Hundred Twenty Seven and
55/100 Dollars ($4,227.55) is hereby awarded to the Ben M. Hogan
Company as the lowest responsible bidder therefor.
SECTION 2. The Mayor and City Clerk are izereby authorized and
directed to execute a contract with the Ben M. Hogan Company for
the widening and paving of said Street in keeping with standards
and specifications as set forth in Ordinance No. 102872 and pursuant
to the bid proposal, which contract and bid proposal shall be in
form and words as follows:

SECTION 3. There is hereby appropriated the sum of Four Thousand
Two Hundred Twenty Seven and 55/100 Dollars ($4)227.55) from the 1958
Street Construction Fund payable to Ben M. Hogan Company in the
manner as provided for by the said plans and specifications.
SECTION 4. The City Manager and Director of Finance are hereby
authorized and directed to execute the necessary warrant for payment
of the sum appropriated in Section 3 hereinabove.
SECTION 5. It has been determined that the width of the street
hereinabove identified creates a hazardous condition to the movement
of vehicular traffic along said street which gravely places in jeopardy
the health, safety and welfare of the citizens of this City; and,
that by widening same as per the plans and specifications herein pro-
vided for said hazardous condition would be corrected; now therefore,
an emergency is hereby declared to exist and this ordinance being
necessary for the preservation of public peace, health and safety
shall be in full force and effect from and after its passage and
approval.

That for and in consideration of the ?ay-wnts to be made, as hereinafter
set forth, the Party of the Second Part hereby agrees to furnish all tools,
labor, equipment and materials, and to build and construct ieW _

Arkansas, Engineer, of the said Party of the First Part, and in exact accord-
ance with the Specifications, Proposals And other Special Provisions attached
hereto and made a part hereof as fully as though copied in full herein, under
the direct supervision and to the entire satisfaction of said Max A. Mehlburger
Engineer, for the 'Party of the First Part and in accordance with the laws of
the State of Arkansas.
2. It is further agreed and understood by and between the parties here-
unto that the Party of the First Part agrees to pay and the Party of the
Second Part agrees to accept as full and final compensation for all work done
under this agreement, the unit prices or l'xV sum amounts named in the pro-
posal which is hereto attached, such payment to be made in lawful money of
the United States, at the time and in the manner set forth in the specifica-
tions.
3. The Party of the Second Part agrees, for the consideration above
expressed, to begin, work within ,O days after being ochre to begin work
by the Engineer, and to complete the work within �,�c� -L
( U ) calendar days thereafter. If the Part y o the Se &6d d Part shall
fa to complete the work in the time herein specified, he shall pay to the
Party of the First Part, as liquidated damages, ascertained 4nd agreed, and

4. The Party of the Second Part agrees to furnish a Performance Bond
with an approved surety thereon, guaranteeing the performance of this con-
tract, as required by the laws of the State of Arkansas, and for not less
than 100% of the amount of this contract. Said bond shall be conditioned
on f ull and complete performance of the c ontract and f or the payment of all
labor and materials entering into or incident to the proposed improvement.

The undersigned do hereby declare:
1. That they have been regularly engaged in contract work of the
class required by the plans, specifications, and contract for e
years, and respectfully invite your attention to the following si
improvements that have been constructed by them.
2. That they have carefully examined the nature and the location of
the work, the contract, and specifications governing the same and hereby
agree to complete the work covered in this proposal in strict conformity
with all documents appended hereto.
3. That they have examined and familiarized themselves with the laws
of Arkansas and ordinances of local public authorities governing work of
this class and safeguarding the public during construction, and will con-
form to such laws and ordinances.

4. That if awarded the contract to commence the work within ten (10)
days after receipt of Work Order from the Engineer, and to fully complete
all work within LO days after date of Work Order.
5. That if awarded the contract, to furnish the Board of Directors
within ten (10) days of the date of the award, an approved surety bond in
the amount of the contract with an approved surety company authorised to
do business in Arkansas, which bond shall particularly provide for the
payment of all material and labor claims arising fray the work. Also that
in order to comply fully with the statutes of the State of Arkansas, to
file the original of the contract bond with the Circuit Clerk of Pulaski
County and furnish the Board evidence of its filing.
