11023ORDINANCE NO. 11,023 AN ORDINANCE TO PROVIDE FOR INSPECTION FEES TO DEFRAY THE COST'OF MEAT INSPECTIONS IN THE CITY OF LITTLE ROCK, ARKANSAS; REPEALING ORDINANCES NOS. 7525, 9125, 10122, 8528, 8790, 10063.AND PROVIDING A PENALTY FOR THE VIO- LATION THEREOF; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION le Fees and records of Inspections: To cover a part of the cost of animal and meat inspection by the Health Department of the City of Little Rock as required by ordinances of the City of Little Rock, the following inspection fees shall be paid to the City Collector by each person, firm, or corporation slaughtering any animal within the separate zones hereby established to be used.for food and which is inspected by the Little Rock Health Department. The following inspection fees shall be paid by each person firm or corporation according to the zone in which they are located, as follows: (a) Zone 1. Within the limits of the City of Little Rock, Arkansas: For grown cattle and yearlings of 250 pounds or more dressed weight, 35¢ each; for all other animals, 25¢ each, plus their share of administration cost as determined by per cent of animals inspected each month. (b) Zone 2. Beyond the c ity limits of the City of Little Rock: For grown cattle and yearlings of 250 pounds or more, dressed Weight, 35¢ each; all other animals, 25¢ each, plus their share of administration cost as determined by per cent of animals inspected each month, plus mileage at the rate of 70 per mile. Provided that in lieu of the above fees any person, firm or corporation, receiving the full time services of an inspector shall pay the full salary of the inspector, as set by city ordinance, and in additioa thereto, shall pay their proportionate share of the administrative cost of the Meat Inspection program. Payment shall be wade in the amount specified by the City Collector, on or before the 10th day of each month. SECTION 2. All persons, firms, or corporations slaughtering cattle and /or operating an establishment, as defined by Section 1 (d) 000 -w` -2- of Ordinance 7273, who have at least one full -time Federal meat inspector upon their premises at all times for the purpose of making inspections under Federal regulations are hereby exempt from the terms and provisions of this ordinance. SECTION 3. Each person, firm or corporation, other than those selling exclusively direct to the consumer, engaged in the business of fabricating, canning,, grinding, curing,, smoking., salting, packing, rendering., the manufacturing of sausage., or in any other way processes meat and /or meat products, shall pay an annual inspection fee in the sum of $275.00, for weekly inspections, and five times this amount for daily inspections, plus their share of ar?ministration costs. Provided that any person, firm or corporation having Federal inspection shall be exempt from the fees imposed by this section, and provided further, that all establishments subject to the inspection and inspection fees provided for in Section 1 of this ordinance shall be exempt from the fees imposed by this section if the above mentioned businesses are conducted in the same or adjoining building to the slaughtering operations. SECTION 4. The inspector shall keep an accurate record of all animals, meat, and meat products inspected by him, and shall make a daily report of his work to the Health Officer on a form provided by the Health Officer. At the end of each month, the Health Officer shall file a copy of said report with the City Collector, who shall collect from each person,, firm., or corporation the inspection fee due for the preceding month. If any person fails to pay the amount due the City as per state- went rendered by the City Collector by the fifteenth of the month following the notification of the amount due,, the City Collector shall notify the City Health Officer, who is hereby authorized and directed to withdraw inspection service from such establishments until such fee is paid; and such person shall be prohibited from processing, manufacturing, bringing, or causing to be brought into the City of Little Rock ant meat or meat products to be or which might be consumed, sold,, or traded in the City of Little Rock. #-- -3- SECTION 5. 111 fees herein provided for shall be used only for the expense of carrying out meat inspection and control ordinances of the City of Little Rock. SECTION 6. Penalty: Any person convicted of a violation of any of the provisions of this ordinance shall be deemed guilty of a mis- demeanor and shall be fined not less than Twenty -five Dollars ($25.00) nor more than One Hundred Dollars ($100.00), and each day of such violation shall constitute a separate offense. SECTION 7. Ordinances No, 7525, 8528, 8790, 9125, 10063, and 10122, and all ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION 8. The administrative cost to maintain inspections required of the animal and meat industry of the City of Little Rock has increased to the point that previous fees charged for inspections are entirely inadequate; and whereas, the total administrative costs for such inspections must be sustained from said fees; and whereas, unless the increase in inspection fees are immnediately placed in effect, the health and safety of the citizens of Little Rock will be gravely endangered; now therefore, ancamergency is hereby declared to exist, and this ordinance being necessary for the preservation of the public peace, health and safety shall take effect from and after its passage.
