11031co Ln 0001% M N N N H H M Ln H Ln N r-i b 0 A ro a) ra c a� aF ORDINANCE NO. 11031 AN ORDINANCE AMENDING SECTION 1 OF ORDINANCE N0. 9600, SAME BEING AN ORDINANCE ADOPTING A FIRE PREVENTION CODE FOR THE CITY OF LITTLE ROCK, ARKANSAS; AMENDING SECTION 26.01 OF ARTICLE 26, SECTION 13.06 OF ARTICLE 13, SECTION 12.02 b. OF ARTICLE 12 AND SECTION 12.05 OF ARTICLE 12 OF THE FIRE PREVENTION CODE; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. Section 1 of Ordinance No. 9600 is hereby amended to read as follows: "Section 1. Adoption of Fire Prevention Code. There is hereby adopted by the Board of Directors of the City of Little Rock for the purpose of prescribing regulations governing conditions hazardous to life and property from fire or explosion, that certain code known as the Fire Prevention Code re- commended by the National Board of Fire Underwriters, being particu- larly the 1956 edition thereof and the whole thereof, save and ex- cept such portions as are hereinafter deleted, modified or amended, of which Code public notice has been given as required by Act, 1949, No. 267, Section 3, and not less than three (3) copies have been and now are filed in the Office of the Clerk of the City of Little Rock, and the same is hereby adopted and incorporated as fully as if set out in length herein, and from the date on which this ordi- nance shall take effect, the provisions thereof shall be controling within the limits of the City of Little Rock." SECTION 2. Section 26.01, Article 26 of the Fire Prevention Code, adopted by Section 1 of this Ordinance, is hereby amended to read as follows: 19SECTION 26.01. Bonfires and outdoor rubbish fires. a. PERMIT REQUIRED. No Person shall kindle or maintain any bonfire or rubbish fire or authorize any such fire to be kindled or maintained on or in any public street, alley, road or other public ground without a permit or other proper authorization. b. LOCATION RESTRICTED. No person shall kindle or maintain boo-16 4 -f -2- any bonfire or rubbish fire or authorize any such fire to be kindled or maintained on any private land unless (1) the location is not less than 50 feet from any structure and adequate provision is made to prevent fire from spreading to within 50 feet of any structure, or (2) the fire is contained in an approved waste burner with closed top, located safely not less than 15 feet from any structure. c. FIRES PROHBITED. No person shall kindle or maintain any bonfire or rubbish fire whatever or authorize any such fire to be kindled or maintained on any private land between sunset and sunrise without a permit or other proper authorization from the Chief of the Fire Department. d. CHIEF MAY PROHIBIT. The Chief of the Fire Department may prohibit any or all bonfires and outdoor rubbish fires when atmospheric conditions or local circumstances make such fires hazardous." SECTION 3. Section 13.06, Article 13 of the Fire Prevention Code, adopted by Section 1 hereof, is hereby amended to read as follows: "Section 13.06. Sprinkler and Alarm System Required. a. Except as provided in paragraph (b) below, buildings which are occupied above the heights permitted by the follow- ing table shall be equipped with approved automatic sprinkler systems. Buildings may be occupied one story higher than speci- fied in (a) above without sprinklers if equipped with an ap- proved automatic fire alarm system. c. Provided, however, that all school buildings, public, private and parochial, in the City of Little Rock not constructed with fire resistive materials shall install either a Fire Detection System approved by the Engineering Division of the Arkansas Inspection and Rating Bureau or an approved Automatic Sprinkler System, with a direct connection to the Fire Alarm Office located in Central Fire Station.16 SECTION 4. Section 12.02 b. of Article 12 of the Fire Prevention Code, 1956 edition, adopted herein, is hereby amended to read as follows: "Section 12.02- Manufacture, Sale and Discharge of Fireworks. b. Except as hereinafter provided it shall be unlawful for any person to store, to offer for sale at retail, expose for sale at retail, sell at retail, or use or explode any fireworks; provided that the Chief of the Fire Department shall have power to adopt reasonable rules and regulations for the granting of permits for supervised public displays of fireworks by the municipality, fair associations, amusement parks, and other or- ganizations. Every such display shall be handled by a competent operator approved by the chiefs of the Police and Fire Departments of the municipality, and shall be of such a character, and so lo- cated, discharged or fired as in the opinion of the Chief of the Fire Department, after proper inspection, shall not be hazardous to property or endanger any person." SECTION 5. Section 12.05 of Article 12 of the said Fire Pre- vention Code is hereby amended to read as follows: "Section 12.05. Exceptions. a. Nothing in this article shall be construed to prohibit -4- any resident wholesaler, dealer, or jobber to sell at wholesale such fireworks as are not herein prohibited or to sell at whole- sale any kind of fireworks permitted by the Laws of the State of Arkansas, provided the same are to be shipped directly out of the limits of this municipality; or the use of fireworks by rail- roads or other transportation agencies for signal purposes or ill- umination, or the sale or use of blank cartridges for a show or theater, or for signal or ceremonial purposes in athletics or sports, or for use by military organizations. b. Fireworks to be sold at wholesale shall be stored in a warehouse set aside for the storage of fireworks only. Said warehouse shall be of fire proof construction consisting of steel or corrugated iron with concrete floors, and a sprinkler system, and the exterior walls of said warehouse shall be situated a mini- mum of forty (40) feet from the side property lines, a minimum of one hundred (100) feet from the front and rear property lines, and a minimum of two hundred (200) feet from any abutting street or public highway. The plans for construction of said warehouse or the utilization of an existing warehouse,and the building materials and fire fighting equipment to be utilized therein, must be first approved by the Chief of the Little Rock Fire De- partment before a building permit or business privilege license shall issue. c. The location of a warehouse for the storage of fireworks in such proximity to any existing building or other improvement, whether residential or business, owned by other persons or corpora- tions, so as to cause a fire insurance rate increase on said building or other improvement shall be prohibited." SECTION 6. All ordinances and parts of ordinances in conflict herewith are hereby repealed and this ordinance shall be in full -5- force and effect from and after its passage and approval.
