AN ORDINANCE AFFIRMING THE ACCEPTANCE OF THE DEDICATION OF
STREET RIGHT -OF -WAY FOR WEST MARKHAM STREET AS REFLECTED
BY THE PLATS OF MIDLAND HILLS ADDITION TO THE CITY OF LITTLE
ROCK, ARKANSAS, RECORDED IN THE OFFICE OF THE RECORDER OF
PULASKI COUNTY, ARKANSAS, AT PAGES 132 AND 150, PLAT BOOK
NUMBER 1; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES.
WHEREAS, it having been made to appear to the Board of Directors
of the City of Little Rock, Arkansas, that the ordinance accepting
the dedication of street right -of -way for West Markham Street be-
tween the junction of Kavanaugh and West Markham Street and Elm Street
as reflected by the plats of Midland Hills Addition to the City of
Little Rock, Arkansas, recorded in the Office of the Recorder of Pul-
aski County, Arkansas, at Pages 132 and 150 of Plat Book Number 1
has been lost, destroyed, misplaced, or inadvertantly omitted from
the records, the said Board of Directors is desirous of affirming
the long continued acceptance of said right -of -way by the City of
Little Rock;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The dedication of street right -of -way for West Mark-
ham Street, heretofore accepted by the City of Little Rock, Arkansas,
and its citizens, as reflected by the plats of Midland Hills Addition
to the City of Little Rock, Arkansas, which plats are recorded at
Page 132 and 150 of Plat Book Number 1 in the Office of the Recorder
of Pulaski County, Arkansas, is hereby ratified, confirmed and in all
things approved.
SECTION 2. The dedication of the street right -of -way for West
Markham Street between the junction of West Markham Street and Kava-
naugh on the East and Elm Street on the West, as reflected by the
plats of Midland Hills Addition to the City of Little Rock, Arkansas,
which plats are recorded in the Office of the Recorder of Pulaski
County, Arkansas, at Page 132 and 150 of Plat Book Number 1 is hereby
accepted and confirmed.

SECTION 3. Sections 1 and 2 of this ordinance are hereby
declared to be severable and should either section of this ordi-
nance be declared unconstitutional and void by a court of competent
jurisdiction, such decision shall in no way affect the validity of
the other remaining section of this ordinance.
SECTION 4. Because of the narrow width of West Markham Street
between Stifft Station and Elm Street which constitutes a hazard
and menance to the life and safety of citizens and an impairment
to traffic control, and because this situation is hostile to the
best interests of the community, an emergency is hereby declared to
exist and this ordinance is found to be necessary for the preservation
of the public peace, health and safety and shall be in full force
and effect from and after its passage and approval.
