ORDINANCE NO. 11,037
AN ORDINANCE AUTHORIZING THE MISSOURI PACIFIC RAILROAD COMPANY, A
MISSOURI CORPORATION, ITS SUCCESSORS AND /OR ASSIGNS, TO CONSTRUCT
A SPUR TRACK ACROSS EAST FOURTH STREET; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF LITTLE ROCK, ARKANSAS:
SECTION 1. The Missouri Pacific Railroad Company, a Missouri
corporation, its successors and /or assigns, is hereby authorized to
construct, maintain and operate, at the expense of the said Missouri
Pacific Railroad Company, its successors and /or assigns, a spur
track across East Fourth Street in the City of Little Rock, Arkansas;
said spur track to be constructed at a location to be approved by
the City. - Engineer between John and Bond Streets, and serving to
connect the Scott Sash & Door Company, Inc. facilities with the
Missouri Pacific Railroad.
SECTION 2. Said Missouri Pacific Railroad Company, its
successors or assigns, shall maintain said track so that the top
of the rails shall be on a level with the grade of the street as
now or hereafter established, and shall be built and maintained so
as not to interfere with any water way or flow of same, and the
City shall have the right to alter said grade at its pleasure without
responsibility to the railroad, its successors or assigns. The
railroad, its successors or assigns, shall also maintain between the
rails of said track and two (2) feet on each side thereof pavement
of like character and material as is now, or may be hereafter,
constructed at said point.
SECTION 3. The use of said track shall be so conducted as not
to interfere with the usual traffic along East Fourth Street.
SECTION 4. For this grant the said Missouri Pacific Railroad
Company, its successors or assigns, shall pay to the City the sum
of Twenty -five Dollars ($25.00) per annum, payable annually in
advance.

SECTION 5. This grant shall be and remain in force and
effect for a period of twenty -five (25) years from and after
the date of the acceptance of this ordinance by the Missouri
Pacific Railroad Company, provided that same is accepted with-
in ninety (90) days after its passage.
