11070ORDINANCE NO. 11,070 AN ORDINANCE DIRECTING THE CITY ATTORNEY TO BRING CONDEMNATION PROCEEDINGS AGAINST A CERTAIN PARCEL OF REAL PROPERTY FRONTING ON UNIVERSITY AVENUE IN THE CITY OF LITTLE ROCK TO BE USED FOR THE PURPOSE OF WIDENING AND PAVING SAID UNIVERSITY AVENUE; AND FOR OT11 PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. The City Attorney is hereby ordered and directed to file in the proper courts proceedings for the condemnation of the following described parcel of real property situated in said City of Little Rock, Arkansas: Beginning at a point that is 45 feet south and 40 feet west of the HE corner of Section 1, T 1 N, R 13 W; thence north parallel to and 40 feet west of the east line of said Section 1, 25 feet to a point; thence west parallel to and 20 feet south of the north line of said Section 11 25 feet to a point; thence in a southeasterly direction along the are of a 25 foot radius curve to the left to the point of beginning, and the west 20 feet of the east 40.0 feet of the south 164.87 feet of the north 184.87 feet of the NE4, NE4, Section 1, T 1 N, R 13 W. Said property is owned by Frank D. Carleton and Mildred F. Carleton, his wife. The property hereinabove described is necessary to be utilized for the purpose of widening University Avenue in the City of Little Rock, Arkansas. SECTION 2. The City Attorney is further directed to secure an Order of the Court allowing the City to take immediate possession of the property described hereinabove upon its posting a bond in an amount to be determined by the Court. The City Attorney is authorized to have posted on behalf of the City a bond in the amount determined by the Court pending final determination of the condemnation proceedings. SECTION 3. All ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION 4. It has been found and determined that the safety of the citizens of the City of Little Rock are jeopardized by reason of the narrow width of University Avenue and that the condemnation of this parcel of real property will enable the widening of said University Avenue so as to reduce said traffic hazard; now therefore, an emergency is hereby declared to exist and this ordinance being necessary for the preservation of public peace, health and safety shall be in full force and effect from and after its passage and approval.
