11090i ORDINANCE N0. 119090 AN ORDINANCE CONDEMNING CERTAIN PARCELS OF REAL PROPERTY FRONTING ON UNIVERSITY AVENUE IN THE CITY OF LITTLE ROCK, ARKANSAS, TO BE USED FOR THE PURPOSE OF WIDENING AND PAVING SAID UNIVERSITY AVENUE; DIRECTING THE CITY ATTORNEY TO BRING CONDEMNATION PROCEEDINGS AGAINST SAID PARCELS OF o REAL PROPERTY; AND FOR OTHER PURPOSES. WHEREAS, in addition to all right -of -way heretofore dedicated, acquired and /or condemned for the purpose of widening and paving Uni- versity Avenue, such parcels of real property fronting on said right- of -way as are hereinafter described are needed for the purpose of widening and paving said Avenue; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. In addition to all right -of -way heretofore dedicated, acquired and /or condemned for the purpose of widening and paving University Avenue in the City of Little Rock, Arkansas, the follow- ing described parcels of real property situated in the City of Little Rock, Arkansas, are hereby condemned, and the City Attorney is hereby ordered and directed to file in the proper courts condemnation pro- ceedings against said parcels of real property: Beginning at the SW corner of Lot 6, Block 23 of Lincoln Park adition to the City of Little Rock, Arkansas, thence North along the East line of Lot 6 and 5 of said Block 23, 60.0 feet to the Northwest corner of said Lot 5; thence East along the North line of said Lot 5, 6.2 feet to a point; thence in a Southwesterly direction 60.1 feet to a point in the South line of said Lot 6 that is 5.0 feet East of the Southwest corner thereof; thence West along the South line of said Lot 6, 5.0 feet to the point of beginning, containing 336.0 square feet more or less. Said property is owned by Maggie May Weedman and Mark Weedman. Beginning at the Southwest corner of Lot 4, Block 23 of Lincoln Park Addition to the City of Little Rock, Arkansas; thence North along the West line of Lots 4, 3, 2 and 1 of said Block 23, 120.0 feet to the Northwest corner of said Lot 1; thence East along the North line of said Lot 1, 8.6 feet to a point; thence in a Southwesterly direction 120.2 feet to a point in the South line of said Lot 4, said point being 6.2 feet East of the south- west corner of said Lot 4; thence West along the South line of said Lot 4, 6.2 feet to the point of beginning, containing 888.0 square feet, more or less. Said property is owned by Mark Weedman. The properties above described are necessary to be utilized for the DOO - /I B -.2 -2- J purpose of widening University Avenue in the City of Little Rock, Arkansas. SECTION 2. The City Attorney is directed to secure an Order allowing the City to take immediate possession of the properties described hereinabove upon its posting a bond or City of Little Rock check in the amount to be determined by the Court. The City Attorney is authorized to have posted on behalf of the City a bond or City of Little Rock check in the amount to be determined by the Court pending final determination of the condemnation proceedings. SECTION 3. All ordinances and parts of ordinances in conflict herewith are hereby repealed. SECTION 4. It has been found and determined that the safety of the citizens of the City of Little Rock is jeopardized by reason of the narrow width of University Avenue and that the condemnation of these parcels of real property will enable the widening of said University Avenue so as to reduce said traffic hazard; now therefore, an emergency is hereby declared to exist, and this ordinance being necessary for the preservation of public peace, health and safety shall be in full force and effect from and after its passage and approval.
