11180ORDINANCE NO. 11,180 AN ORDINANCE VACATING, ABANDONING AND CLOSING A PORTION OF ROOSEVELT STREET (SOMETIMES CALLED "L" STREET) IN THE CITY OF LITTLE ROCK, ARKANSAS. WHEREAS, a petition wss duly filed by Pat M. Riley, Martha M. Riley, Ellery Clark Gay, Lillian Allie Gay, Edwin L. Baxley, Helen E. Baxley, Louis F. Muench, Bernice McEwen Muench, Milton L. Loeb, Mimi B. Loeb, Phillip Landman and Marilyn Landman, with the Board of Directors of the City of Little Rock, Arkansas, asking the Board of Directors to vacate, abandon and close all that portion of Roosevelt Street (sometimes called "L" Street) in the City of Little Rock, Arkansas, located between Lot 10, Ranch Valley Addition, and Lots 25 and 26, South Normandy Addition, on the North, and Block 2, Pleasant Hill Addition, and Lots 1 and 4, Replat of North 192 feet of Block 1, Pleasant Hill Addition on the South, as more particularly described hereinafter; and WHEREAS, after due notice as required by law, the Board of Directors has, at the time and place mentioned in the Notice, heard all persons desiring to be heard on the question and has ascertained that the portion of Roosevelt Street (sometimes called "L" Street), hereinafter described, has heretofore been dedicated to the public use as a street, has not been actually used by the public generally as a street or road for a period of at least five (5) years subsequent to the filing of the plats of said additions referred to above, that petitioners are the only abutting landowners upon the portion of the street to be vacated, and accordingly all abutting landowners have consented to such abandonment, and that the public interest and welfare will not be adversely affected by the abandonment of such street. V670- ;�/ 4 - l'o - 2 - NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: Section 1. The City of Little Rock, Arkansas, hereby releases, vacates and abandons all its rights, together with the rights of the public generally, but specifically excepting any utility ease- ments now in effect, including those specifically mentioned in Section 2 and 3 hereofjin and to the street described as follows: That portion of Roosevelt Street adjacent to and abutting the South boundary line of Lot 10, Ranch Valley Addition, and Lots 25 and 26, South Normandy Addition, and adjacent to and abutting the North boundary line of Blocks 1 and 2, Pleasant Hill Addition, all in the City of Little Rock, Arkansas, and more particularly described as follows: Begin at a point five feet East of the Northwest corner of Block 2, Pleasant Hill Addition to the City of Little Rock, Arkansas; thence North to the Southwest corner of Lot 10, Ranch Valley Addition to the City of Little Rock, Arkansas; thence East along the South boundary line of said Lot 10, Ranch Valley Addition to the City of Little Rock, Arkansas, and Lots 26 and 25, South Normandy Addition to the City of Little Rock, Arkansas, to the Southeast corner of said Lot 25, South Normandy Addition to the City of Little Rock, Arkansas; thence South to a point 20 feet West of the Northeast corner of Block 1, Pleasant Hill Addition to the City of Little Rock, Arkansas; thence West along the North line of Block 1 and Block 2, Pleasant Hill Addition to the City of Little Rock, Arkansas, to the point of beginning, same being a point five feet East of the Northwest corner of Block 2, Pleasant Hill Addition to the City of Little Rock, Arkansas; and that the ownership thereof except as to said utility easements shall vest in the owners of the abutting property, the owners of said lots in Ranch Valley Addition and South Normandy Addition, as to take title to the North Half (N2) thereof, referred to above4and the owners of said Lots (or Block) in Pleasant Hill Addition as referred to above, to take title to the South Half (S Z) thereof. Section 2. This street closing is subject to the same rights prior to and at the time of this closing which Arkansas Power & Light Company has under its franchise granted by the City of Little Rock. - 3 - Section 3. A utility easement five (5) feet in width is reserved unto Southwestern Bell Telephone Company, its successors and assigns, for the location of its telephone line along the route of its presently existing line now crossing said portion of Roosevelt Street (sometimes called "L" Street) being closed hereby. Section 4. A copy of this Ordinance, duly certified by the City Clerk, shall be filed in the Office of the Recorder of Pulaski County, Arkansas, and recorded in the deed records of said County. Section 5. This Ordinance shall take effect and be in force from and after its passage. Section 6. All ordinances or parts of ordinances in conflict herewith are hereby repealed.
