11213ORDINANCE NO. 11,213 AN ORDINANCE APPROVING THE ANNEXATION TO THE CITY OF LITTLE ROCK OF CERTAIN LANDS LOCATED IN THE NORTHEAST QUARTER OF SECTION 27, TOWNSHIP 2 NORTH, RANGE 13 WEST, PULASKI COUNTY, ARKANSAS. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK: SECTION 1. It appearing that on July 3, 1961, the County Court of Pulaski County, Arkansas, entered its order, subsequently amended by order of September 7, 1961, pursuant to Section 19 -301 to 19 -306, inclusive, of Arkansas Statutes (1947), Annotated, as amended by Act 142 of the General Assembly of the State of Arkansas for the year 1953, approved February 25, 1953, authorizing the annexation to the City of Little Rock of the following described land in Pulaski County, Arkansas: Part of NEk Section 27, Township 2 North, Range 13 West, Pulaski County, Arkansas, more particularly described as follows: Beginning at Southwest corner of NEk NEk of said Section 27; thence run North along West line of said NEk NEk 833.6 feet; thence South 77 degrees 05 minutes East 164.4 feet to the point of beginning of this description; from the point of beginning thus established, thence run South 74 degrees 42 minutes East 250.5 feet; thence run South 74 degrees 56 minutes East 260.4 feet; thence run South 70 degrees 01 minutes East to a point on the present city limits line of the City of Little Rock, Arkansas; and on Westerly right of way line of Robinwood Drive; thence Southerly along the present city limits line of the City of Little Rock, Arkansas and Westerly right of way line of Robinwood Drive to the Northerly right of way line of Arkansas State Highway No. 10; thence in a Southeasterly direction along the Northerly line of said Highway (which is also the present city limits line) to the East line of the NEk of said Section 27; thence South 0 degrees 56 minutes East 82.5 feet along the present City €� M 1 . ` limits line to the South right of way line of State Highway No. 10; thence East 30 feet to the East right of way line of Reservoir Road (if same were extended North) and along the present city limits line; thence in a southerly direction along the East line of said Reservoir Road 298 feet; thence West 60 feet; thence North 74 degrees 35 minutes West 193.2 feet; thence North 43 degrees 17 minutes West 466.7 feet; thence North 42 degrees 04 minutes West 60.5 feet; thence North 41 degrees 51 minutes West 299.2 feet; thence North 70 degrees 07 minutes West 264.4 feet; thence North 74 degrees 10 minutes West 201 feet; thence North 26 degrees 58 minutes East 334 feet to the Southerly right of way line of Arkansas State Highway No. 10; thence across said highway on a line perpendicular to the center line of said highway to the Northerly line of said high- way; thence in a Westerly direction along the northerly line of said highway to a point which is South 9 degrees 53 minutes West 178.7 feet from the point of beginning; thence run North 9 degrees 53 minutes East 178.7 feet to the point of beginning. Said order of annexation was entered upon the hearing of a peti- tion filed in said Court by Richard B. Elwood and others on June 2, 1961; and SECTION 2. It further appearing that more than 30 days have elapsed since the rendition and entry of said order of the County Court and that no person, firm or corporation has insti- tuted any proceeding to have such annexation prevented and that no notice has been given to the authorities of the City of Little Rock of any attempt to vacate, review, set aside or appeal from said order; SECTION 3. NOW, THEREFORE, BE IT ORDAINED that the City of Little Rock, acting through this Board of Directors, does hereby approve such annexation and does hereby accept, as a part of the incorporated area of this City, all of the land described in SECTION 1 of this Ordinance. SECTION 4. IT IS FURTHER ORDERED that, pursuant to Section 19 -305 of Arkansas Statutes (1947), Annotated, a certified copy of this Ordinance shall be delivered to the Secretary of the State of Arkansas along with a certified copy of the entire proceedings (including plat) of the Pulaski County Court in connection with such annexation, the certification of the Pulaski County Court proceedings to be made by the County Clerk. SECTION 5. It is hereby ascertained and declared that persons whose business interests are centered within the City of Little Rock reside upon the lands to be annexed hereunder; that said lands are contiguous to, and adjoining, the City of Little Rock and constitute a logical area for the extension of the populated area of said City; that said lands are served by the same public utility companies which serve the City of Little Rock and also are served by water and sewer utility installations owned and operated by the City of Little Rock; that the annexa- tion of said lands will give the proprietors the benefit of fire and police protection, including the benefit of more favorable insurance rates, and will give the City the benefit of the taxa- tion of said lands. It is, therefore, declared that an emergency exists, and that this Ordinance is necessary for the immediate preservation of the public health, peace and safety, and this Ordinance shall take effect from and after its passage.
