AN ORDINANCE APPROPRIATING FROM UNAPPROPRIATED SURPLUS THE
SUM OF TWENTY THOUSAND FIVE HUNDRED AND N01100 DOLLARS
($202500.00) TO STREET RIGHT -OF -WAY FUND, PROJECT 39 (UNI-
VERSITY AVENUE) FOR SETTLEMENT OF CLAIMS AGAINST THE CITY
OF LITTLE ROCK; AUTHORIZING THE CITY MANAGER AND DIRECTOR
OF FINANCE TO PAY OUT SAID SUM TO CERTAIN PERSONS; DECLARING
AN EMERGENCY; AND FOR OTHER PURPOSES.
BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE
ROCK, ARFA1.NSAS :
SECTION 1. There is hereby appropriated the sum of Ttigenty
Thousand Five Hundred and No /100 Dollars ($20,500.00) from un-
appropriated surplus in the General Fund, previously allocated
by Resolution No. 2546 for right -of -way purposes, to Street
Right-of-Way Fund, Project 39 (University Avenue) .
SECTION 2. The City Manager and Director of Finance are
hereby authorized and directed to pay from the moneys appropriated
in Section 1. hereof, to the persons listed below the sums set
opposite their names, which sums represent full and final settle-
ment of any and all claims which they may have against the City
of Little Rock arising out of a certain lawsuit filed in the
Circuit Court of Pulaski County, Arkansas, Case No. 49387, styled
Charles M. Wisener and Margaret F. Wisener v. City of Little Rock,
Arkansas:
Charles M. Wisener and Margaret F. Wisener, his
wife, Leon B. Catlett and Josh W. McHughes --------- $20,000.00
Read, Stevenson & Dick ------------------------------ $ 225.00
Fulls & Company--------------------------------- - - - - -$ 225.00
SECTION 3. It has been found and determined that the City has
become obligated to certain parties arising from construction of
University Avenue and the seLtlement of litigation pursuant thereto,
and that this Ordinance is necessary in order for the City to meet

its obligations and liabilities when due; now therefore, an emergency
is hereby declared to e -Kist and this ordinance being necessary for
the preservation of the public peace, health and safety shall be
in full force and effect from and after its passage and approval.
