11269ORDINANCE NO. 110269 AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF LITTLE ROCK, ARKANSAS, BY ADDING AN ARTICLE TO CHAPTER 11, DESIGNATED ARTICLE II, TO BE KNOWN AS EMERGENCY INTERIM SUCCESSORS TO MUNICIPAL OFFICES; AND FOR OTHER PURPOSES. WHEREAS, Act 489 of 1961 of the General Assembly of the State of Arkansas authorizes and directs that municipal corpo- rations within the State of Arkansas provide that certain elected officers of municipalities designate interim successors so as to provide for a continuity of local government in the event of attack and unavailability of duly authorized and constituted officers; and WHEREAS, it is the desire of the Board of Directors of the City of Little Rock to comply with said Act in all respects; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That the Code of Ordinances of the City of Little Rock, Arkansas, is hereby amended by adding an Article to Chapter 11 to be known as Article II, which said Article shall read as follows: "ARTICLE II. EMERGENCY INTERIM SUCCESSORS TO MUNICIPAL "Sec. 11 -11. Definitions. "The following definitions of terms shall apply for purposes of this ordinance as follows: "(a) 'Unavailable' means either that a vacancy in office exists and there is no deputy authorized to exercise all of the powers and discharge the duties of the office, or that the lawful incumbent of the office is absent or unable to exercise the powers and discharge the duties of the office. '(b) 'Emergency interim successor' means a person designated pursuant to this act, in the event the OGD -7.? - 2 - officer is unavailable, to exercise the powers and discharge the duties of an office until a successor is appointed or elected and qualified as may be provided by the constitution, statutes, charters, and ordinances, or until the lawful incumbent is able to resume the exercise of the powers and discharge the duties of the office. "(c) 'Office' means a position on the Board of Direc- tors of the City of Little Rock and duties of which are defined by the statutes, charters and ordinances. "(d) 'Attack' means any attack or series of attacks by an enemy of the United States causing, or which may cause, substantial damage or injury to civilian property or persons in the United States in any manner by sabotage or by the use of bombs, missiles, shellfire, or atomic, radiological, chemical, bac- teriological, or biological means, or other weapons or processes. "Sec. 11 -12. __Appointment of Emergency Successors oitions on Board -ot directors. "The members of the Board of Directors of the City of Little Rock, Arkansas, shall, individually, name emergency interim successors for their respective position only, and shall name not less than three (3) nor more than seven (7) such emergency interim successors. The emergency interim successors shall be named by a title or by named person and said names shall be listed in their order of succession. "Sec. 11 -13. Certification of Appointments. "Each list furnished and executed by individual members of the Board of Directors shall be certified by the City r� - 3 - Clerk of Little Rock, Arkansas. Three (3) copies of every list shall be kept at all times in the Office of the City Clerk of Little Rock, Arkansas. "Sec. 11 -14. Periodical Review of Lists. "Each member of the Board of Directors shall review the list of successors to his position at reasonable intervals to insure its current status. "Sec. 11 -15. Method of Changing or Altering Appointments. "Any change in appointment of emergency interim suc- cessors to a position on the Board of Directors shall be effected by the execution of an entirely new list which shall reflect any change desired, the latest such list, by date shown thereon, prevailing over all prior incon- sistent lists theretofore filed for the particular position. "Sec. 11 -16. Powers of Emergency Interim Successor. "In the event that any member of the Board of Directors of the City of Little Rock shall be unavailable as the result, either directly or indirectly, of an attack, the powers of the office held by such unavailable officer shall be exercised and duties shall be discharged by the desig- nated emergency interim successor in the order specified. Such emergency interim successor shall exercise the powers and discharge the duties of the office until such time as an emergency interim successor in higher or superior priority becomes available, until a duly constituted and appointed officer shall be elected in accordance with the statutes or ordinances applicable, or until the duly con- stituted and appointed officer becomes available to exer- cise the powers and discharge the duties of his office. "Sec. 11 -17. Oath of Office. "At the time of the designation and appointment as an emergency interim successor, said emergency interim succes- sor shall take such oath as may be required for him to t - 4 - exercise the powers and discharge the duties of the office to which he may succeed."
