AN ORDINANCE VACATING, ABANDONING AND CLOSING
EAST EIGHTH STREET BETWEEN CALHOUN AND APPERSON
STREETS IN THE CITY OF LITTLE ROCK, ARKAM AS.
WHEREAS, a Petition was duly filed by the Little Rock School
District, Little Rock, Arkansas, petitioner, with the Board of
Directors of the City of Little Rock, Arkansas, asking the Board
of Directors to vacate, abandon and close East Eighth Street
between Calhoun and Apperson Streets in the City of Little Rock,
Arkansas, same being located bwtween Blocks Two (2) and Three (3) ,
FAIRGROUNDS ADDITION to the City of Little Rock, Arkansas, as
more particularly described in said Petition and hereafter; and
WHEREAS, after due notice as required by law, the Board of
Directors has, at the time and place mentioned in the Notice,
heard all persons desiring to be heard on the question and has
ascertained that East Eighth Street between Calhoun and Apperson
Streets is no longer needed or required for corporate purposes
or for use by the general public and adjoining owners in that
other streets are available and used for these purposes, that
Petitioner is the only abutting landowner upon the portion of
East Eighth Street to be vacated and accordingly all abutting land-
owners have consented to such abandonment, and that the public
interest and welfare will not be adversely affected by the aban-
donment thereof;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF
THE CITY OF LITTLE ROCK, ARKANSAS:
Section 1. The City of Little Rock, Arkansas, here releases,
vacates and abandons all its rights, together with the rights of

the public generally, in and to East Eighth Street located between
Calhoun and Apperson Streets described as follows:
East Eighth Street located between Calhoun Street on
the East and Apperson Street on the West, and between
Blocks 2 and 3, FAIRGROUNDS ADDITION to the City of
Little Rock, Pulaski County, Arkansas, more particularly
described as follows:
Beginning at the southwest corner of Block 2, FAIRGROUNDS
ADDITION, said corner being the point of intersection
of the North right -of -way line of East 8th Street and
the East right -of -way line of Calhoun Street; thence
East along said North right -of -way line of East 8th
Street to the southeast corner of said Block 2, said
corner being the point of intersection of the North
right -of -way line of East 8th Street and the West right -
of -way line of Apperson Street; thence South to the
northeast corner of Block 3, FAIRGROUNDS ADDITION, said
corner being the point of intersection of the South
right -of -way line of East 8th Street and the West right -
of -way line of Apperson Street; thence West along the
South right -of -way line of East 8th Street to the
Northwest corner of said Block 3, said corner being
the point of intersection of the South right -of -way line
of East 8th Street and the East right -of -way line of
Calhoun Street; thence North to the point of beginning;
and that the ownership thereof except as to utility easements pro-
vided for in Section 2 hereafter shall vest in the owner of the
abutting property.
Section 2. The rights now held by any public utility company,
under the laws of the State of Arkansas or under grants heretofore
made by the City of Little Rock, Arkansas, to use the above described
part of East Eighth Street for the location and operation of lines
and facilities for the furnishing of public utility sevvices,
shall not be abrogated, dimirashed or changed by the enactment of
this Ordinance, and utility easements now in effect are specifically
excepted from this closing, including easement of Arkansas Louisiana
Gas Company for a two inch (2 ") high pressure gas line presently
in existence, same being a ten foot (10")_ easement, five feet (5')
on either side of the existing line, easement of the Little Rock
Municipal Waterworks for an eight inch (8 ") water main, same being

a ten foot (10') easement, five feet (5') on either side of the
presently existing water main, and easements fn r presently
existing facilkies of Arkansas Power & Light Company, and South-
western Bell Telephone Company.
Section 3. A copy of this Ordinance, duly certified by the
City Clerk, shall be filed in the Office of the Recorder of
Pulaski County,&kansas, and recorded in the deed records of
said County.
Section 4. This Ordinance shall take effect and be in force
from and after its passage.
Section 5. All ordinances or parts of ordinances in conflict
herewith are hereby repealed.
