ORDINANCE N0. 11.286 AN ORDINANCE AUTHORIZING THE CONVEYANCE OF CERTAIN REAL PROPERTY SITUATED IN PULASKI COUNTY, ARKANSAS, WITH PURCHASE PRICE TO BE PAID TO BOARD OF COMMISSIONERS OF LITTLE ROCK MUNICIPAL WATER WORKS WHEREAS, the Board of Commissioners of the Little Rock Municipal Water Works, by resolution duly enacted on the 18th day of May, 1962, has requested the Board of Directors of the City of Little Rock, Arkansas, to approve the sale of the hereinafter described real property held in the name of the City of Little Rock for the use and benefit of the Little Rock Municipal Water Works; and WHEREAS, the said Board of Commissioners has determined that said lands are no longer required for waterworks purposes and that a sale upon the terms and conditions herein set forth will be to the best interest of the City of Little Rock; and WHEREAS, the Board of Directors of the City of Little Rock concurs in said determination; Now, Therefore, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. That the Mayor and City Clerk of Little Rock, Arkansas, be, and they are hereby, authorized and directed to execute a warranty deed on behalf of the City of Little Rock, conveying to H. J. Caldwell the following described real property situated in Pulaski County, Arkansas, to -wit: Commence at a point where the North right of way line of Cantrell Road joins the East right of way line of Jessie Road in the City of Little Rock, Arkansas, and run thence Northeasterly along the East right of way line of Jessie Road 251.8 feet to the South right of way line of the Chicago, Rock Island & Pacific Railroad; thence Southeasterly along said South right of way line 779.9 feet, more or less, to the North right of way line of Cantrell Road; thence in a Westerly direction GFJp -7 I. along the North right of way line of Cantrell Road 774.2 feet, more or less, to the point of beginning; subject, nevertheless, to easements for a power line and a telephone cable now crossing said property, and reserving to the City of Little Rock easements five (5) feet in width on each side of the following facilities as now situated upon the premises: One 24- inch sanitary sewer; three 24 -inch, one 20 -inch, one 16 -inch and one 12 -inch storm sewers; and a water pipe line; paved parking areas and driveways may be constructed across any of the easements herein reserved; buildings may be constructed over any sewer easement containing cast iron pipe, if the City Engineer approves the construction plan and issues a building permit therefor. Said conveyance shall be for a cash consideration of Twenty Five Thousand and no /100 Dollars ($25,000.00) payable to the Board of Commissioners of the Little Rock Municipal Water Works. SECTION 2. J. Caldwell has offered to purchase said lands for the sum of $25,000.00 cash, which is in excess of the appraised value thereof; Now, Therefore, BE IT RESOLVED by the Board of Commissioners of the Little Rock Municipal Water Works that the Board of Directors of the City of Little Rock, Arkansas, be requested to approve the sale of said lands in accordance with and upon the terms set forth in the copies of the proposed ordinance and deed attached hereto. Passed and unanimously adopted this 18th day of May, 1962. ., Certificate I, H. J. Burford, Chairman of the Board of Commissioners of the Little Rock Municipal Water Works, certify that the above and foregoing is a correct copy of a resolution adopted by said Board of Commissioners at its regular meeting held May 18, 19622 in the City of Little Rock, Arkansas.
