11292.� A*' ORDINANCE NO. 11,292 AN ORDINANCE APPROPRIATING ONE THOUSAND ONE HUNDRED EIGHT AND 67/100 DOLLARS ($1,108.67) TO THE BUDGET ACCOUNT OF THE SANITATION DEPARTMENT 154 -5.1; AMENDING ORDINANCE NO. 11,241, SAME BEING THE BUDGET ORDINANCE OF THE CITY OF LITTLE ROCK FOR THE YEAR 19623% TO PROVIDE FOR SAID APPROPRIATION; APPROVING THE EXPENDITURE OF ONE THOUSAND ONE HUNDRED EIGHT AND 67/100 DOLLARS ($1,108.67) TO WALTER T. EVANS AS FULL COMPROMISE AND SETTLEMENT FOR DAMAGES TO HIS AUTOMOBILE; DECLARING AN EMERGENCY; AND FOR OTHER PURPOSES. WHEREAS, the City of Little Rock, Arkansas, by Ordinance No. 10,949, established standards and procedures for the pro- cessing of personal property damage claims against the City of Little Rock, which ordinance, among other things, provided that the City Manager would have authority to settle and pay claims not exceeding One Hundred Dollars ($100.00); and WHEREAS, the claim of Walter T. Evans exceeds the One Hundred Dollar ($100.00) limitation; and WHEREAS, the City Manager and City Attorney recommend that said claim be settled for One Thousand One Hundred Eight and 67/100 Dollars ($1,108.67); and WHEREAS, the Board of Directors of the City of Little Rock desires to appropriate from unappropriated surplus in the General Fund the amount needed to pay such claim and, also, to authorize payment thereof to Walter T. Evans as full compro- mise and settlement for damages to his vehicle; NOW THtREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. There is hereby appropriated from unappropriated surplus in the General Fund to Sanitation - Account No. 154 -5.1 the sum of One Thousand One Hundred Eight and 67/100 Dollars ($1,108.67), which appropriation is to provide money for the payment C Oo - a E -/0 � s -2- of a damage claim of Walter T. Evans. SECTION 2. Subsection a. under Section JJ.(5) of Ordinance No. 11,241, same being the Budget Ordinance of the City of Little Rock for the year 1962, is hereby amended to read as follows: Estimated 1961 1962 "a. 5.1 Judgment & Damages $500.00 $12608.6711 SECTION 3. There is hereby approved the expenditure of One Thousand One Hundred Eight and 67/100 Dollars ($1,108.67) to Walter T. Evans as full compromise and settlement for damages to his vehicle arising out of a collision with a vehicle owned by the City of Little Rock, which occurred on May 1, 1962, in the 2700 Block on South High Street in the said City. SECTION 4. The City Manager and Director of Finance are hereby authorized and directed to issue the necessary warrant for the payment of money approved in Section 3 hereinabove, which money shall be charged to Account 5.1 of the Sanitation Department in accordance with Section 6 of Ordinance No. 10,949. SECTION 5. It has been found and determined that it is to the best interest of the City of Little Rock and the public generally to pay as speedily as possible all damage claims when payment of such claims is deemed necessary and prudent, and this ordinance is neces- sary for payment of an acknowledged and approved claim; now there- fore, an emergency is hereby declared to exist and this ordinance shall be in full force and effect from and after its passage and approval.
