11324ORDINANCE NO. 11 -,324 AN ORDINANCE GRANTING A FRANCHISE TO MR. & MRS. H. W. BLAKE, THEIR HEIRS, EXECUTORS OR ASSIGNS, TO PLACE METAL WASTE PAPER RECEPTACLES ON THE STREETS OF THE CITY OF LITTLE ROCK, ARKANSAS; REPEALING ORDINANCE NO. 7453; AND FOR OTHER PURPOSES. BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. An exclusive right and privilege is hereby granted N to Mr. & Mrs. H. W. Blake, their heirs, executors or assigns, to place rn ,-i on or about the rights -of -way and public thoroughfares in the City of Little Rock metal waste receptacles into which the public may con - b veniently deposit waste paper, refuse, litter and debris. A ,u SECTION 2. This franchise right and privilege shall run for a 0 vperiod of five (5) years from date. The Grantees herein, their heirs, executors or assigns, as a part of the consideration for this franchise, do covenant and agree to place upon the public rights -of -way and thorough- fares in the City of Little Rock, and at no cost to the said City, suf- ficient receptacles in the downtown area to permit convenient waste disposal by the public. The Grantees, their heirs, executors and assigns, are further granted permission to place upon the exterior of such recep- tacles advertising of any and all types, except advertising for whiskey, beer, wine or other alcoholic beverages. The receptacles used by Grantees, their heirs, executors or assigns, shall be entirely metal with an inner metal removable lining and shall be anchored in a suitable and safe manner for stability and shall be entirely fireproof. SECTION 3. The location of all such waste receptacles shall be at all times subject to the approval of the Director of the Department of Community Development of the City, and the appropriate Departments of the City of Little Rock shall at all times have the right to remove waste materials which accumulate in the said receptacles. SECTION 4. The rights accruing to the Grantees, their heirs, execu- tors or assigns, hereunder shall be assignable only upon prior written E-5- -2- consent of the Director of the Department of Community Development of the City of Little Rock, and all of the terms and covenants herein shall be binding upon any assignee hereunder. SECTION 5. Ordinance No. 7453, passed November 10, 1947, is hereby repealed in its entirety and all other ordinances and parts of ordinances in conflict herewith are hereby repealed, and this Ordinance shall take effect and be in full force from and after its passage and approval.
