ORDINANCE OF THE BOARD OF DIRECTORS OF THE CITY
OF LITTLE ROCK, ARKANSAS, VACATING AND CLOSING
THE ALLEY IN BLOCK ONE, KANIS IS ADDITION TO THE
CITY OF LITTLE ROCK, ARKANSAS.
WHEREAS, a petition was duly filed with the Board of Directors of the
City of Little Rock, Arkansas, on the 28thday of January , 1963, asking
the Board of Directors to vacate and abandon all of the alley in Block One,
Kanis's Addition to the City of Little Rock, as designated on the plat of said
Addition now appearing of record in Deed Book AB, Page 316, in the office of
the Recorder of Pulaski County, Arkansas, subject, however, to any public
easements in said alley; and
WHEREAS, after due notices as required by law, the Board of Directors
has, at the time and place mentioned in the notice, heard all persons desiring to
be heard on the question and has ascertained that the alley, hereinbefore des-
cribed, has heretofore been dedicated to the public use as an alley, as herein
described; has not been actually used by the public generally for a period of at
least five (5) years subsequent to the filing of the plat; that all of the owners of
the property abutting upon the alley to be vacated have filed with the Board of
Directors their written consent to such abandonment; and that public interest
and welfare will not be adversely affected by the abandonment of such alley;
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS
OF THE CITY OF LITTLE ROCK, ARKANSAS:
SECTION 1. The City of Little Rock releases, vacates and abandons all of
its rights, together with the rights of the public generally, except and subject
to the rights of public utilities as hereinafter stated in Section 2, in and to the
alley described as follows:
That alley running East and West in Block One (1) in F. Kanis's
Addition to the City of Little Rock, Arkansas, connecting what
is now Tyler Street to the West and Harrison Street to the East
and running parallel to 12th Street to the North and 13th Street
to the South,

SECTION 2. The rights now held by any public utility company under
the laws of the State of Arkansas or grants heretofore made to any such
utility company by the City to occupy and use the alley hereina.bove described
for the location, construction, maintenance and operation of its lines,
circuits, facilities and equipment for the supplying of public utility services
are hereby expressly excepted from the rights hereinabove released, vacated
and abandoned by the City; and the releasing, vacating and abandoning by the
City of the said alley are subject to such rights now held by any public utility
company.
SECTION 3. A copy of this Ordinance, duly certified by the City Clerk,
shall be filed in the office of the Recorder of Pulaski County and recorded
in the Deed Records of the County.
SECTION 4. This Ordinance shall take effect and be in force from and
after its passage.
