ORDINANCE NO. 11,388
AN ORDINANCE ACCEPTING THE RECOMMENDATION OF THE LITTLE
ROCK PLANNING COMMISSION RESPECTING THE ESTABLISHMENT
OF A PARKS, PLAYGROUNDS AND RECREATIONAL AREAS PLAN FOR
N THE LITTLE ROCK PLANNING AREA, AND RELATED MATTERS;
C14 ESTABLISHING SAID PLAN; REPEALING ORDINANCE NO. 11,354;
AND FOR OTHER PURPOSES.

ROCK, ARKANSAS:

Ln SECTION 1. Acceptance of the Report. A resolution adopted
by the Little Rock Planning Commission on January 10, 19632
entitled: "A Resolution Approving and Adopting the Parks, Play-
grounds and.Recreational Areas Plan for the Little Rock Planning
Area and Recommending Said Plan to the Board -of Directors of the
City of Little bock, Arkansas," is hereby accepted as the report
and recommendation of said Commission respecting the matters therein

set forth.
� SECTION 2. Adoption of the Plan. There is hereby adopted,
as the First Component of the Community Facilities Plan for the
Little Rock Planning Area, and as part of the Little Rock Municipal
•A Plan, shown on maps and charts bearing the title "Parks, Playgrounds
o and Recreational Areas Plan of the Little Rock Planning Area; and

>1M by the signature of the Chairman of the Little Rock Planning Commis -
bw sion duly attested by the Secretary of said Commission, and by the
01-4 signature of the Mayor duly attested by the City Clerk, which maps

this ordinance as fully as if described herein at length.

SECTION 3. Establishment of Classifications. For the purpose
of this ordinance and plan, there are hereby established three class-
ifications of park playground and recreational sites designated as
follows:

The various sites are further identified by number, all as shown
on the plans documents described in Section 2 of this ordinance.
SECTION 4. Planning Specifications. The parks, playgrounds
and recreational areas shown on the plan presently serve, or shall
be planned to serve their functions according to the following:
1. Metropolitan Area Park - a large park or reservation,
designed to preserve the scenic features of the areas, and
intended to provide the setting for diversified recreation
and enjoyment by large numbers of people living throughout
the metropolitan area.
2. Community Park - a community center and playfield park,
designed and equipped to serve the active and passive recrea-
tional needs of several neighborhoods, and having a service
radius of approximately one mile.
3. Neighborhood Park - a recreational center and play lot,
designed and equipped to serve the active play needs of
children residing within easy walking distance.
SECTION 5. Authority, Jurisdiction, Implementation and En-
forcement.
(a) Any subdivider of land within the planning area of the
Little hock Planning Commission, who proposes to make or have made a
subdivision of said land, shall conform to this plan by indicating
on any plats or drawing submitted to said Commission for its consid-
eration, any and all proposed park facilitiesin definitely fixed and
describable locations identified on this plan by symbol "F" which are
located within the said property, and shall plat said park lands to
the dimensions and in the location determined by said Commission.
Such park lands shall be reserved for acquisition by the City of
Little Rock, Arkansas. Such acquisition must be made within twelve
(12) months from the date the subdivider's plat is presented to the
Little Rock Planning Commission. Further, acquisition shall be
deemed as having been made when either an option to purchase is
executed or litigation to condemn is filed by the City of Little Rock.
It is further provided that no subdivider shall be denied the privi-
lege of having a plat approved solely by reason of the issue of re-
served park lands unless the City of Little Pock determines and ad-
vises the said subdivider, within sixty (60) days from the date his
plat is presented to the Little Rock Planning Commission, that public
funds for the acquisition of the said park lands will be available
within twelve (12) months from the date said plat is so presented.
(b) Whenever the Little Rock Planning Commission is presented
with a request for consideration of a plat involving the expansion
of any mapped existing facility, or a proposed facility in a definitely
fixed and described location,said Commission shall require, in con-
junction with the approval of the plat, reservation of the park land
as stipulated above.
(c) Land encompassed within the areas identified on this
plan and referred to as symbol "G", designated for a "proposed
facility in a general location, need not be shown on any plat or

drawing submitted to the Planning Commission for its consideration
in the subdivision of land or otherwise.
(d) No building permit shall be issued for any structure on
any lot or parcel on which any definitely fixed and describable
park lands is indicated unless it has first been determined that
the proposed structure would not lie within the proposed bounds of
said park lands, or unless otherwise authorized under the provisions
of said Act 186 of 1957. Nothing herein contained, however, shall
be construed to .deny a permit for the use of such lot or parcel for
purposes not involving the construction or relocation of buildings.
(e) This plan shall be duly considered prior to action on
any matter related thereto which comes before the Little Zock Plan-
ning Commission, this Board, or any of the departments, agencies,
boards,or commissions` °of.this City.
SECTION 6. Recording.- A copy of this ordinance, together
with the maps and charts referred to herein, shall be filed in
the Office of the Recorder of Pulaski County as required by Act 186
of 1957 of the,: General A'ssem`bly of the State of Arkansas.
SECTION 7. Severability. If any section, clause, paragraph,
provision or portion of, this ordinance and plan shall be held invalid
or unconstitutional by any court of competent jurisdiction, such
holding shall not affect any other section, clause, paragraph, pro-
vision or portion of these rules and regulations.
SECTION 8. Effective Date. This
No. 11,354 in its entirety and shall be
from and after its passage and approval.
