11393A c� 0 A w a W P4 w a ORDINANCE NO. 11093 AN ORDINANCE CREATING AN HISTORIC DISTRICT COMMISSION WITHIN THE CITY OF LITTLE ROCK; PROVIDING FOR POWERS AND LIMITATIONS OF THE SAID COMZIISSION; AND FOR OTHER PURPOSES. WHEREAS, Act 484 of 1963, approved 'March 20, 1963, was passed by the General assembly of the State of _= ,rkansas for the purpose of allowing certain municipalities to undertake pro- cedures for the preservation of historic landmarks and improve- meets; and WHEREAS, the City of Little Rock is impowered under the said Act to effect steps and measures to preserve and protect buildings, sites, places and districts of historic interest by the creation of an Historic District Commission; and WHEREAS, it is the desire of the City of Little Pock, :. -irk- ansas, to implement the intention of said tact 484 of 1963 by creating such a commission; NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE CITY OF LITTLE ROCK, ARKANSAS: SECTION 1. There is hereby created within the City of Little Rock, Arkansas, an Historic District Commission consisting of City Manager five (5) members appointed by the /:y-rr and subject to confirma- tion by the Board of Directors of this City; each of whom shall be electors of this municipality holding no salaried or elective municipal office. Of the five (5) members so appointed, one (1) shall serve for a term of one (1) year, two (2) for a term of two (2) years and two (2) for a term of three (3) years. All appointments made upon the expiration o: the original terms of the members of the said Commission shall be for three (3) years. Vacancies shall be filled in a like manner for the unexpired term. All members shall serve without compensation. The said t2eO - 33 C -.S' -2- Commission shall elec� a chairman and vice - chairman annually from its own number. SECTION 2. The Historic District Commission established in Section 1 hereof shall make investigation and a report on the historic significance of the buildings, structures, features, sites or surroundings, included in such proposed historic dis- trict and shall transmit copies of its report to the Arkansas History Commission and the Planning Commission of this City for consideration and recommendation, and each such body shall give its recommendation to the Historic District Commission regarding the contents of the report within sixty (60) days from the date of receipt of such report. Such recommendations shall be read in full at the public hearing to be held by the Historic Dis- trict Commission as hereinafter specified. Failure by the Plan- ning Commission of this City to make recommendations on the re- port within sixty (60) days after receipt thereof shall be taken as approval of the report of the Historic District Commission. SECTION 3. The Historic District Commission shall hold a public hearing on the establishment of a proposed historic dis- trict after giving notice of such hearing by publication in a newspaper of general circulation in this City once a week for three (3) consecutive weeks, the first such publication to be at least twenty (20) days prior to said public hearing. Such notice shall include the time and place of said hearing, specify the purpose and describe the boundaries of the proposed historic district. SECTION 4. The Historic District Commission shall submit a final report with its recommendations and a draft of a proposed -3- ordinance to the Board of Directors of this City within sixty (60) days after the public hearing called for in Section 2 hereof. The final report submitted to the Board of Directors of this City shall contain the following: (a) A complete description of the area or areas to be included in the historic district or districts. Any single historic district may embrace non -con- tiguous lands; (b) A map showing the exact boundaries of the area or areas to be included within the proposed dis- trict or districts; (c) A proposed ordinance designed to implement the provisions of Act 484 of 1963, approved March 20, ! 1963, by the General Assembly of the State of Arkansas; (d) Such other matters as the Commission may deem necessary and advisable.
